From your description of the event, the police and DVLA were clearly waiting for you to move the SORNed vehicle, and knew you were likely to be doing so at that time.

This suggests that they had either engaged in "Directed Surveillance" and / or the neighbour had been acting as a "Covert Human Intelligence Source" or "CHIS", (perhaps supplying his CCTV footage of your driveway to the police). In either case they would have to have obtained authorisation from a Senior Officer, with relevant paperwork signed off under the Regulation of Investigatory Powers Act (RIPA). This Authorisation would have to declare that their actions were 'necessary and proportionate" in relation to the crime they were trying to detect or prevent. I'd wager that no such RIPA authorisation has been obtained, and if so it would be hard to conclude that it was proportionate in your circumstances.
Had I or one of my officers asked for a RIPA authorisation under these circumstances I think we would have found ourselves rapidly transferred to rather less demanding duties, perhaps issued with a blunt pencil and a notebook made of toilet paper.
 
I guess the motorhome is still insured while sorn?
or there may be a potential further fine coming your way.

Book it in for an MOT on a Sunday morning while it's still on SORN (assume it's insured?)
Drive off your drive in full view, leave it running on the road for ten minutes then toddle off the the garage - see if there are any law enforcement or VOSA when you come back :LOL:
 
If his half of the drive has risen , can you put a kerb or short wall / thin concrete barrier to divert all the muck from his side down his drive to the pavement / gutter ?

I am very sympathetic as we also have a neighbour from hell and a shared drive which he has partially blocked. We extended our drive and used line marker to delineate his drive from ours. He's got brown underpants thinking we are going to put a fence down the shared drive :)

Nope when we moved in he was all over us when the removals van was a foot on his side of the shared driveway , ,, he walks all over my half but anyone who goes on his side gets moaned at ,,, then there is his illegal improvements and drainage ..

But i think it may be another issue and not just the neighbour , he is a problem but he is on a sticky wicket if he is involved . , I have called one of the lawyers with the group i am a volunteer member off that is investigating police abuses ,, He has told me that he will get some of the team to look into it ,, I sent him the video and recordings , he thinks its all a bit convenient and looks like police harassment , he also says the neighbours actions need to be checked carefully . He also says we will speak with previous owner about any issues with neighbour and he will get someone to speak with my mate at number 14 too...he took the video and has had issues with the twat at number 13 .

I would rent out the house but its not an easy thing ,... ongoing health treatments , cant be away all the time , i would have to store all my stuff , I would need an address for my Banks, Pensions, legals, doctors etc,, plus how do you ensure a decent paying tenant who wont destroy your property or not pay the rent ????

jerryz & Puddleduck I'd put some Heras fencing up on your side of the boundary whilst the neighbour is out. Cheap as chips second hand. Park a vehicle in the road up to the boundary position. Moving the heras fence becomes an issue for your non lovely neighbours that may involve trespass and damage/theft of/to your property.

Whilst these apply to preventing egress from a driveway, blocking access isn't covered:
The Highway Code Rule 243, and The Traffic Management Act 2004, Part 6, 86.

if concrete then brick cleaner is ideal: Here you can buy the equivalent in most supermarkets which is 'salfuman' & is dilute hydrochloric acid. Identical to brick cleaner & costs cents .
for asphalt petrol is best

To the Op I would also get on to your council as these days most do not allow any type of solid surface due to environmental concerns over rainwater run off. In many areas 2m2 is the maximum allowed for any type of slab

I was fined for not insuring after taxing (historic car in storage - tax free) had to SORN or insure

I think the OP should just tax the MH and move on (y)
 
My father was done moved car out put camper in garden car not taxed fined.

As the OP states it is sorned but is put on road regularly to get bikes out.

These routine checks have been going on for years. Dvla pick an area and bliz it.

Unfortunately they had probably already been down the road with number plate recognition vehicle. And as its the time of year vans are being put on the road seems wrong time wrong place.

I keep a car fully taxed and insured that did 397miles last year and the dvla tax avoidance car has been seen in the village twice recently.

At least they didn't clamp or tow it. They were in their rights to do so.

I think what was meant was assuming as it was sorned that the op wouldn't have bothered insuring it but that's not necessarily the case as a lot would want to keep insurance in place as if it gets nicked it's otherwise a total loss. If there was no insurance as well it's actually a higher penalty than no tax

i think you reading this incorrectly my point is if a vehicle is sorn and the insurance has also lapsed and is on the highway then the offence is no tax and no insurance.

i do agree the op should move on.

We can't park on the road as it isn't wide enough. We could park on our bit of the drive of course.

When the hire car was delivered (ours in the garage after a breakdown - several weeks delay on parts and only 20 months old) the second car ( to take the first driver home ) parked in front of his gates on the drive. He was not a happy chappy especially when told "Only 10 minutes mate".

Well my mates Video has good sound and its very clear how rude the police have been ,, they saw him video the incident and asked him to delete it he refused ,, He is very angry he says its clear harrassment ,,,
The police can’t ask to see or delete any photos or video without a warrant.

Not strictly true. They can ask to see it, but if you refuse can either seek a warrant or arrest you if they have grounds and seize the evidence. As a Data Controller over a CCTV system, the police can ask to see the footage at any time and can insist without warrant if it is needed for a criminal investigation. If you continue to refuse, then yes they need a search warrant or a court order.

I assure you that I would that is why I am very careful about where I go & what I do as even day to day I rarely get out the front gate with having lost the plot.
& I would have sorted the neighbour out long before now ,& regularly , regardless of what the consequences were. He would have had to have moved long ago ,he certainly wouldn't be living there .

In the long term, you need to start planning to move house.

In the short term you could move into the motorhome for the summer and travel.

Maybe seriously look at moving most of your stuff out of the house and rent it out for a year or so whilst you decide what to do next.

I'm sure there is a Heavy Rock band attached to the local Chapter of the Hells Angels, who are nice lads really once you get to know them who would be happy to rent the house for a year, as long as the garden is long enough for the axe throwing competitions and the drive is big enough for a dozen large motorbikes.
Or rent it to Serco on a 5 year contract to house half a dozen illegal boat people. With the benefit of all maintenance covered by Serco including dilapidations at the end of the 5 years. That would teach your neighbour for being such an arsehole.

I think for your own mental health, you should try and put your van in storage,temporarily,and put the house up for sale. Life is far too short to be at war with your neighbour,as it seems to have an adverse affect on you,(my friend hates his neighbour but thrives on the venom they throw at each other) whereas it appears to be making you very unhappy…………… cut and run,you could be somewhere nicer for christmas… regards pam
 
I have had issues with the neighbour for months His newly raised driveway is illegal as it drains directly onto my side and he closed his drains, he also directed his refurbished garden drains onto my side so its always getting flooded and covered in mud ,, if i as much as step on his side he gets angry so I cant push my bikes out ,, The deeds say driveway is share d but he does not care , he has erected 4 cameras to monitor the drive way, my garage and also the gardens .
If the deeds say the drive is shared then just use it to push your bike out to the street. If he gets angry with you . So what. He can't physically touch you or you can call the police. Just put your phone on record and record what he says/ does. Bit you are within your rights to use the shared drive.
 
You could of course invite Gus over for the weekend.
Or the Funsters Uke group plus my son in law plays drums..... And I have heard ShiftZZ is a great guitar player.
