Got Stung by. “Dealer”

Did you get your original £2000 deposit back?

To be fair to both posters, why would they join here before they had a motorhome, just to find out if they are scams , they might not have heard of such things on motorhomes, I certainly didn't till being on here, there was loads of stuff I didn't know till being on here and that's getting on for fourteen years ago now, better times maybe .
But that doesn't excuse the original poster on the other thread from telling us about a scam dealer, incase someone else falls into the same trap.
its called due dilligence chas befor i buy anything i do research

You know that and I know that but everyone doesn't.
I don't pay for anything till it's in my hand motorhome or not.
Some people are just too trusting.
Some of the stories we have heard on here over the years just make you wonder.

I would still chase for the deposit back. Go to trading standards and let them sort it. The guy who has it is a bit of a wide boy from all accounts

ianbbb. So would I Ian, as a point of principle. It's easy money if he gets away with it.
Put it in the hands of those who deal with this type of thing on a daily basis, and they'll soon tell you if you have a case against him of not, and get the ball rolling.
You can then forget about it until informed otherwise. It doesn't need to be eating away at you all the time, and you never know, you might get a pleasant surprise. ;)

Good luck going forward. 👍

Jock. :)

I've not read anything in this thread as evidence of illegality. Why encourage the OP to potentially incur further costs? First establish the terms of the deposit. Could be a gift, goodwill gesture?
Got caught, learn and move on 😠.

Yes I'm afraid that's my take on this as well, it's hard I know but what's the point in deposits if they have to give them back, might just as well not had one.

Because a dealer is possibly selling a damp van he’s just bought very cheap?

Suggesting that the OP checks the T& Cs of the deposit, and if necessary goes to CAB for advice, is hardly encouraging them to potentially incur costs. Nor is informing Trading Standards, should it be discovered that there has been an element of unscrupulous behaviour on the part of the dealer. 🤷

If it is deemed necessary, the OP is hardly likely to engage the services of a solicitor, unless winning his case is " a dead cert". I got the impression from an earlier post by the OP, that he is unlikely to go down that route anyway, so again, no costs incurred.

Cheers,

Jock. :)

If the dealer represented that the camper was in VGC he was telling you porkies if he purchased it knowing it was damp and wanted to sell it to you in the same condition, which is pretty obvious, a very short time later. I suggest a solicitors letter, which shouldn’t cost much, reminding him that it is an offence under theft act 1968 to obtain property ( your money) by deception.
It's now simply called Fraud under the Fraud Act and it's a lot easier to navigate around than the old Theft Act (does that still apply in Scotland?).

Edit:
As suspected, the Fraud Act 2006 does NOT apply in Scotland.

Here's some light reading for those 'stung' North of the border.
