Got Stung by. “Dealer”

Went to look at a motorhome last week and put a £2000 deposit on it via bank transfer. Next day I found out that the small time dealer had bought it from autotrader price reduced due to damp. ( This was only a few days before selling to me. Concerned I’d bought a pup I called him to say I didn’t want to proceed and linking him a copy of the old autotrader app he said that my deposit was non refundable. He is now not answering any calls or messages from me. Can he hold back my deposit 2 k is a big hit to take.
The dealer is Tay leisure Dundee. Owned by Tom Mullen. Anyone had any dealings with him. I would advise anyone to steer clear
 
If the dealer represented that the camper was in VGC he was telling you porkies if he purchased it knowing it was damp and wanted to sell it to you in the same condition, which is pretty obvious, a very short time later. I suggest a solicitors letter, which shouldn’t cost much, reminding him that it is an offence under theft act 1968 to obtain property ( your money) by deception.

Is this the same dealer as the other thread that's running?

but would that stand if the vehicle has been mis-sold, eg with a clean bill of health with no damp?:unsure:

It's a difficult one as you haven't actually bought it yet, so it might not be in the 'mis selling' criteria.
I suppose it depends on what the terms of the deposit/sale you made were?

If someone buys something and then advertises it 'as is' for sale privately, I don't think I here is any comeback, if it's a business then I think there are more safeguards in place after a sale has been completed, but the terms of the deposit may be the crucial factor.

You really do need to take professional advice at the earliest opportunity!!!

Seems to be a couple of people who joined same day with similar issues rather than join before to get advice about paying deposits by CC and not handing over rest till you've inspected van after all agreed work done at handover?

Strange though two people with very similar story and both seem to be in Scotland or near to.

I think I understand what you're saying and apologise if it wasn't what you meant, but I like this forum for that exact reason .... Try before you buy, and I'm pretty sure that if the forums business model wasn't working, someone 'up top' would change it ....
None of us need to answer any newbie enquiries, however I will continue to as I hope others will aswell.

I don't actually know if the forum is open for anyone to read or if they have to register/join to search and read posts?
 
Well you've paid a deposit, you may as well go see it so you know where the company is. When there you can discuss face to face any issues with damp etc. Go armed with any knowledge and legislation about getting your deposit back. If he refuses to allow you to see van then a proper rabbit off.

I understand what you're saying, but I like this forum for that exact reason .... Try before you buy, and I'm pretty sure that if the forums business model wasn't working, someone 'up top' would change it ....
None of us need to answer any newbie enquiries, however I will continue to as I hope others will aswell.

Sorry not sure of your point? I just stated 2 people have similar issue and both joined same day, what's that got to do with forum business model?

I apologise, I was actually editing my post as you replied, in case I misread your post, which obviously I did !

Yes it's a public open forum that anyone can see though I think certain parts are hidden.

To be fair to both posters, why would they join here before they had a motorhome, just to find out if they are scams , they might not have heard of such things on motorhomes, I certainly didn't till being on here, there was loads of stuff I didn't know till being on here and that's getting on for fourteen years ago now, better times maybe .
But that doesn't excuse the original poster on the other thread from telling us about a scam dealer, incase someone else falls into the same trap.
 
Just to add I have purchase a MH private now and delighted with it. Looking forward to reading through the forum for tips and others experiences. We are new to Motorhomes but had caravans in the past.
That was fast ..... I assume you're still chasing your deposit?
