Just a link to information which may be of use if you are looking to overstay in Europe.
 
I have a suggestion for anyone that wants to overstay in France.

Just as your 90 days are nearly up, apply for residency (not citizenship) on the premis you you arrived before 1/1/21 (untrue probably) and that you benefit from the Withdrawal Agreement.

Its an online tickbox process, takes maybe half an hour. Immediately you'll get an email acknowledgement of your application and a temporary right to stay in France while your application is being processed.

That would buy you 2-3 months grace. You won't have started anything irreversible. It should work but I'm not seriously recommending it. 🤣

Or claim asylum, regularly ......but then leave the country if your own accord ...

There has been many excuses from people here in Spain, and all the advice has been you have to leave or you will be fined and deported and could be banned from returning, I'm sure some of them will try and take the chance, some think because they were here before the 1st January with no stamp will get away with it, there might be some that don't drive 🤔 because they are always stopping vehicles 😯 that might slip through the net. 😁

But anyone that did get banned that likes to travel in a motorhome, might find it difficult getting it from the UK to a non schengen area without large shipping costs. 🤔 Bob.

Thats interesting. What does deportation actually mean and how is it applied in the context of a Motor Home and the Schengen area. Do you have to leave via the nearest schengen border. Can you cross a national border to get to a Schengen border. If you have proven yourself to be a law breaker, I can hardly see them saying "oh yes now you drive from here in Greece to Calais"
 
Blimey, I bet that would cost a Euro or two. I bet it would make it uneconomical to repatriate the MH, even if the person had the money.

And you would need to be lucky to get away with that one .

Here in Poland it got a bit messy for Brits trying to get Residency under the Withdrawal Agreement: from March last year(2020) until !st Jan 2021, but then they did not have the forms for Brits ready for weeks. Eventually we were able to Register, but then they could not give a Receipt of Application to allow travel out/in to Schenge, but they did send it a few weeks later, which makes me OK, even when my 90 days runs out in 17 days. Still no card.

I still do not know whether a MH can be deemed to have 'overstayed'? In most EU/Schengen countries a vehicle has to be re-registered locally after 90 or 180 days.

Poland, so far, contrary to an ECJ ruling against them, has refused to re-register out RHD MH. I am not too worried about the situation in Poland, because I think I could confuse the authorities here enough so that they would not know what to do, but if I travel through other countries and my own papers show I have been in Schengen more than 90 days, but the MH has not been registered in Poland, will they accept Polish refusal as a valid excuse - maybe the law in Germany/Netherlands etc. does not make it an offence not to re-register in another country, but I do not know.

This starts to sound like fictional cases from A. P. Herbert's 'Uncommon Law' - I can recommend to anyone who has not read them, bloody hilarious.

I think I might shoot off a round-robin to all the Schengen Embassies with the question of what the law is in this situation in their country - without of course quoting the MH registration! If I do I shall of course sign it with my qualifications of LL.B., Barrister-at-Law:LOL::LOL:

Headucashun. i didn't know those were the NON Schengen countries. Then again never bothered to look. Thanks for the info.
