So if one smokes in one's vehicle can one sue the motor insurers if one contracts cancer?

Fortunately I cannot see a British Adjudicator and Court coming to the same conclusion.

God help us, I just can't see why the insurance company were liable in any way for people's irresponsible sexual behaviour.

I would have thought it takes two to have consensual unprotected sex with a partner, so I'm surprised the amount wasn't reduced at least. It might be because he knew he had an sti, and she didn't.

It isn't what most sensible people would regard as an injury though, it was an std passed on through irresponsible consensual behaviour that could have been avoided with a little due care.
I'd have awarded them both the cost of a packet of condoms and a referral to the clap clinic.

What i dont get is they say the injuries normally covered are things like slamming your fingers in the door.

On the basis she was aware (stated) of his disease and consented to the other form of slamming then this would encourage people to knowingly put their fingers in a door and have the door (by consent) slammed on them and be entitled to a payout stating this as a stated case. Bonkers

How on earth did she prove she contracted it in the car? If he was an ex boyfriend one presumes they had sex on prior occasions, was it only ever in the car? And were there witnesses?
