Lynne is applying for a Irish passport so she can stay over the 90 days limit .

I do not have a Irish passport and my question Is does this also give me freedom of movement in the Schengen Area if I am married to Lynne and travelling with her can we both stay for more than 90 days.

Interesting, a conversation I had just last week with Kelso who has a uk passport, and who’s wife holds a Danish passport, believes that her freedom of movement rights extend to him also as they are married.....
Hopefully he will see this post and respond with the information he has re that 👍

That’s what we thought Dave but someone we met today told us different.

I seem to remember it's the same if a UK passport holder marries someone from another country it doesn't automatically give them the right to move and live here if they are from outside the EU.
 
Sound like depravation of human rights to me.
I would probable be dead by the time it's gone to the European court for a ruling.
Just because u are married does not give a right to bring your spouse into this country so why would it else where.
 
After reading this blog it looks like you can travel with your spouse under
the directive below , I will look Into it more

European Directive 2004/38/EC is a EU wide directive or instruction that the Schengen rules have to comply with, therefore all of the Schengen rules, codes, and regulations are written with this in mind.

Your passport will be scanned when you enter and leave the Schengen area
 
I've checked this. I am like you and unfortunately you are not included. My Wife could have both a French and Irish passport but not me.

Very Easily.
Both UK and Schengen area governments have been doing this for years.

You are counted in and you are counted back out again.

Overstay at your peril:
You risk
Deportation,
Being blocked for return for a number of years,
A large fine,
and your motorhome can be crushed.

And don't for one second think they wont do it, they have been doing it for many years to citizens of lots of other countries, we have voted away our free pass in exchange to being locked in.

Our children will look back in wonder at what their parents and grandparents gave away in exchange for nothing

I agree you cannot get a passport but if you are travelling with your partner in the Schengen area you still get freedom of movement as long as they are travelling on a EU passport

If you are travelling by yourself the Schengen rules apply ie 90 day

Unfourtantley when you present your passport at the border control, when entering and then when leaving the shenegan area.

I can't see why not as any spouse or family member of an EU citizen has the same rights in the spouses resident state.If the EU citizen moves country the non-eu spouse + any family members has an automatic right to residency so I can't see how it can be outlawed by the WA as members woud be from another EU state, i.e. Ireland?

As above .It definitely applies if married .& also if you move country.
I seem to remember it's the same if a UK passport holder marries someone from another country it doesn't automatically give them the right to move and live here if they are from outside the EU.
That is just UK rules. Here in spain if an national or permanent foreign resident marries a non.eu spouse they have the right to reside & obtain a tarjeta Identidad de Extranjero automatically.

A mate married his partner who came here from Turkey, after going through hoops of fire and about £10 later she has citizenship.

Everything I have read so far states as long as you are travelling with your spouse on a EU passport you can travel for more than 90 days
 
Please don’t turn this thread into another brexit thread a lot of people are looking for information
 
There is a case being brought before the EU Court regarding the fact Brexit is a different thing from the Schengzen Treaty.

As a point of clarity, Ireland is NOT part of the Schengen area, although of course it IS in the EU. They are two different things.

I agree but they still have freedom of movement the UK was also not a member of Schengen
