High level front positioning lights - Do I need them?

Someone on another forum has been told is 2004 MoHol wouldn't pass an MOT.
I only have them on the rear of my 2012 - Is this a new requirement?

I don't have them on my 2015 and just passed the MOT last week. I do however, have them on the sides at the rear
 
Below are the exemptions in RVLR 1989

End-outline marker lamp Schedule 13: Part I

A vehicle having a maximum speed not exceeding 25 mph;

A motor vehicle having an overall width not exceeding 2100 mm;

An incomplete vehicle proceeding to a works for completion or to a place where it is to be stored or displayed for sale;

A motor vehicle first used before 1st April 1991.

The items in RED are applicable to your vehicle possibly ?


@Zigisla if the lights you have at side rear has a front white lens then that would comply with the requirement . If needed by width spec . moholight.jpg

:xrofl::xrofl: Just re-read my reply and half of it is missing:xdoh: It was meant to finish with "I do however, have them on the sides at the rear..which show white lights to the front and red lights to the rear.":rolleyes:
