High level front positioning lights - Do I need them?

Someone on another forum has been told is 2004 MoHol wouldn't pass an MOT.
I only have them on the rear of my 2012 - Is this a new requirement?

I don't have them on my 2015 and just passed the MOT last week. I do however, have them on the sides at the rear

Below are the exemptions in RVLR 1989

End-outline marker lamp Schedule 13: Part I

A vehicle having a maximum speed not exceeding 25 mph;

A motor vehicle having an overall width not exceeding 2100 mm;

An incomplete vehicle proceeding to a works for completion or to a place where it is to be stored or displayed for sale;

A motor vehicle first used before 1st April 1991.

The items in RED are applicable to your vehicle possibly ?

@Zigisla if the lights you have at side rear has a front white lens then that would comply with the requirement . If needed by width spec .

Just re-read my reply and half of it is missing It was meant to finish with "I do however, have them on the sides at the rear..which show white lights to the front and red lights to the rear."
