Help urgently needed,
We have a m/home which goes over the 3500kg limit, so i have to apply with the bus/lorry forms, and have a medical and vision test.
At 70 this went straight through, no problem. However in between then and hitting 73 (29/11/18) i was diagnosed with Lung Cancer.
I have and am having Chemo and according to my Consultant i am doing super well, big reductions in size and virtually no side effects.
But two day ago i recieved the reply from DVLA in which they have revoked my C1/D1 entitlement "after receiving medical information as part of the enquiry that tells them that my medication makes me "drowsy and confused throughout the day". This info was obtained from their own medical panel as my GP and my Consultant have not heard from them.
As i do not have the side effects they say, in fact they allowed my motorcycle and car licence, it seems i will have to appeal, which is through the magistrates court, so now it starts to get complicated and costly.
Does anybody know of a specialist solicitor who may help

I can't help with the appeal as I am in Scotland and the process is very different and almost impossible as by the time you get the letter you only have a couple of days to appeal at the Sheriff Court. I actually managed to get a ministerial concession on that one as instead of the appeal time starting when the letter was sent it now starts on receipt on the letter.

I got my MP involved and he was going to make a complaint via the Parliamentary and Health Service Ombudsman https://www.ombudsman.org.uk/ as the procedure used by the DVLA was incorrect in my case (and maybe yours). It didn't get that far as my circumstances were reviewed and my licence reinstated.

Hi @Bar-Le-Duc We successfully got my husbands licence reinstated after it was revoked. This was for a heart condition. We appealed ourselves without having to get a solicitor or go to magistrates. I got a lot of help from funsters throughout the process. Happy to help you if I can.

To do an appeal yourself you need to find new medical info. If the info is not new the dvla will not entertain an appeal. So first I think you have to find out exactly what medical information they have on you and where it came from. One of your medical practitioners must have given it, otherwise how could the dvla know?
Once you have all that information you can make an informed decision on whether they have the full facts or not. Then it is just a matter of gathering extra facts from doctors, test results etc.

This may not help but when I phoned the dvla medical helpline, after failing my eye test they were very helpful and constructive in finding solutions. The same help was also given when after an operation I was banned from driving for six months.

I would just appeal then the DVLA will send you for a medical which they pay for ,If the result comes back in your favour they will reinstate your licence .
 
It just a guess, but if you listed your medication on the medical form, it may be they made their decision on possible side effects o that medication. If your doctor is prepared to give a statement that you don't suffer from these it may help.

It's always a bit of a worry in the back of the mind for those of us who drive larger vans and are over 70.
Will we pass the medical again next time and what to do if not?

Can't give you any advice but do wish you the best of luck with your appeal and recovery.

Just a thought.
No doubt the OP is on Medication? He gets his prescription and that could be the 'Back Door' to the DVLA reading the contra indications on the medications. How many meds. do we take that somewhere it says, "If taking, do not operate machinery." or "May make you drowsy"
