We have found an option for a new van arriving in August. Can you please advise me if there is any way to hold a showroom to that deal? We would be ok putting down a deposit but what if it kept slipping and slipping. No use to us and by then showrooms may be open etc. Has anyone done a deal where the deposit is returned if the van isn't delivered within a certain timeframe? Thanks

The contract we signed, included the reasons a deposit could be returned, they were:-

parties cannot agree on trade in value on inspection
van cannot be delivered within 30 days of agreed delivery date.

dont think you got much hope of that unless you agree and have written a specific added clause. most if not all contracts have some sort of get out for the dealer on late delivery.

Hard to estimate delivery times at the moment, they may be short if the demand is low or they could be extended as the manufacturer may have cut back on production. All I can say is if it's a German van it will probably arrive on time, the 3 we have had have been on time or early.

Whatever deposit you put on a van it should never be more than you can afford to lose, we have only ever put down £1000 on new vans.
You could raise your own purchase order to the dealer stating "Delivery is the essence of the Contract".

That sounds just like what we need! Perfect. Did you instigate that or did the dealer provide it?

It was on the dealers standard terms, on the reverse of the contract.

I paraphrased above, here’s the paragraph

I think the phrase "estimated delivery date" needs to be stronger as the dealer could amend it! Something like "delivery date stated on this document" or "original delivery date" perhaps?

The contract itself clearly states this date using the same terms, difficult to amend when I have a copy (y)

Thanks so much. Great info. Feel a bit more confident now.
