Bought a faulty used item. What should I do?

I recently bought an item on here which turned out to have an undisclosed physical fault. No idea if the seller knew about it or not, it's possible they didn't.

I want to return it as it's no use to me as it is, and fixing it will push the price I paid up close to a new item (which will have a warranty, etc.)

Problem is, the seller has gone silent on me. I've made several attempts to contact them, telling them about the fault and my intention to return it. I have seen from their forum profile that they have been online, but I have had no response at all.

I'm reluctant to just send the item back without their acknowledgement, as I may be sending into a black hole and lose both the item and my money. I'm also being deliberately vague in this post as to the seller and the item because there may be a good reason for their silence, though that doesn't help me.

What you you advise?

The real way to deal with this issue is the following....

Firstly, Jim has already contacted and asked for a response.... seems fair...

I then think the Seller, should post on here with all the information pleading their case....
The reciever of the item can then post their case...

Chris will preside over proceedings....

we will select a poll, for the righteous, and determine the rights and wrongs... and establish the one true winner.

wont make either party feel any better, but it makes great TV.

Just be grateful that gus-lopez isn't in the legal profession as we all know what the sentence would be ... booooooooommmmm! :giggle:

You’re not being very friendly, either. How do you know the OP is being deliberately ignored. We have 2000 posts a day here. Many tens of thousands of notifications, messages get missed and lost, Notifications pile up; and plenty of people only pop in for a few minutes a day some only once a week, and many more a lot less than that. Put your pitchfork down and take a deep breath.

Perhaps as you're the Judge and Jury and pronounced the seller guilty, you could enlighten the rest of us what evidence there is that the product was faulty when sold and that the messages have been read?

There are way too many people around nowadays that have no morals whatsoever and don’t care about shafting others. Just look at all the scam websites, fake Facebook adverts, fake eBay sellers that are out there. The amount of dodgy second hand cars. Or you get the “oh, it must’ve got damaged / lost in the post “ crap. No, sorry, I have very little trust in other human beings nowadays. That’s another topic though, crap postal companies that don’t care what happens to your parcel once they have your money.
I hope this gets sorted out for the benefit of the buyer ( and seller ) but I won’t hold my breath.

Why would anyone risk their good name for £160 don't get me wrong I like my cash as much as anyone, but a satnav is knackered after a couple of years anyway and you are far better using your phone, that's up to date every day.
I can't remember all the duff say navs I have thrown away once they go wrong can't imagine trying to sell one or come to that buy one second hand .
If he doesn't come up with the refund he wants naming and shaming but it's no big deal either road.

Thousands of people get scammed every day and it’s getting worse.
There are still some out there that are great people but rapidly getting out numbered. It’s also getting increasingly harder to spot the scams too. Purely down to greed and selfishness.

I don’t know why we have a default of not receiving notifications? Why not get notifications and have to opt out. ?
As things stand my phone seems to stop notifications every few days so that I have to opt into receiving notifications again. PIA
I know if I turn my phone off, when I turn it back on I have to enable notifications,

Dont forget sellers get scammed at least as much as buyers. I could write a book on the tricks people have tried on me!

I regularly buy and sell items on Ebay. I ensure the items I sell are in good working order and I a very careful with my descriptions. If a buyer discovered that an item I sold them was faulty or not as described I would offer a full refund providing the buyer returned the item to me. I think that is the right and decent thing to do. There should be a certain amount of trust between online buyers/sellers, even more so on a forum where both are members. I would have thought that a member who sells a faulty item, knowingly or not, should be prepared to correspond with a buyer at the very least to arrive at a mutually acceptable solution. Which he now has, so all good.

That is true! I used to sell laptops and PCs on Ebay for beer money. I would get them now and again from clients sites and refurb them and it was good fun. You won't meet anyone more honest than me and I always would describe any faults etc. There was this trick where people just put stupid bids in and win the item then just clear off and never pay but I started getting them where people would pay for say a laptop, then at the last minute window (30 days I think) complain to ebay that it was not as described. You have to give a refund so you get it back and there is either nothing wrong with it or they have swapped something or other.

Took all the fun out of it so I packed up.

When I sold my ancient Kontiki last summer my friends picked on my ad. Said it described way too many faults. Everything was listed from the dodgy gearbox to you having to have a special nack to light the fire! :LOL: It sold in 24 hours and I could have sold it six times over. Honesty is the best policy.

I think so. You've been rude to the seller, with no clear evidence that he was ignoring anyone. There is no need for that here.

A decent person wouldn’t be ignoring you would they?

They ignore all attempts at contacting them to resolve an issue.

Selling faulty stuff without mentioning the fault is pretty damn unfriendly too!

It is being reported that in the pilot community , The Indian crash investigators are interviewing passengers on 2 earlier recent flights of the crashed plane on reports from passengers of system failures on the 2 previous flights of the crashed plane where no electrical toilet pumps and fans , lights, and entertainment systems worked or were intermittant ,,, but apparently the re was no inspection after those flights ?????

I have bought a few things on Classified, and a couple of them have not worked properly, one costing a few hundred pounds.
I'm fairly certain, (and hope) on both occasions, the seller didn't know and I have put it down as experience but will be reluctant to buy from these two individuals again but who knows....... it's like an auction, it's the gamble you take? 🤔

Just my two penneth - never had a problem Buying here that wasn't resolved within 24 hours chatting to seller. Never had a problem selling items and one recent item I even expressly said if it's faulty, show me the fault and I'll have it back minus carriage. (As I couldn't expressly test it myself but was supplied in good faith to me).

I do tend to have a look at if the seller is relatively new though. (y)

You get all sorts buying and selling....

I sold a genuine Louis Vuitton bag on Ebay that I had bought on the Champs Elysees when I was about 18 - I'd been doing work experience at an accountancy firm pre-uni for a month, remuneration was board and lodging, hadn't expected a pay packet but got one at the end .... went and blew it all on a Petit Noé bag ...... years later, it was virtually unused so I listed it. I took loads of photos including the serial number. The girl I sold it to worked in a solicitors office. She insisted it was fake so I asked her to return it and sent her the photo of the serial number that I expected the return to match. Never heard from her again.

On another occasion I sold a bundle of baby clothes. I had underestimated the postage cost so ended up making no money. A week later I received a surprise letter from the buyer with a cheque for the postage!

I believe this has now been resolved amicably. I also believe that, as I hoped, there was a reasonable explanation for the lack of contact.

I never intended to get the pitchforks out, I was genuinely curious as to what I should be entitled to when buying second hand (no point pressing for a refund if I was being unreasonable or expecting too much, etc.)

Also no use advertising it at an almost new price when someone can buy it with a full manufacturer's warranty!

I have a rough policy. If I am selling something second hand I sell it for ½ the price I could buy it new for now (Not what I paid for it).
Unless it is still as new, in box, unused. Then I make a judgement call and maybe 60-70% of new price.

I do the same when buying. Second hand I never pay more than 50% of the new cost. Unless it is as new, in box, unused then maybe go as high as 60%.

Buying second hand from a private seller you lose the warranty and any rights you have if bought from a business.

I am a member of a group on Facebook where members buy and sell surplus craft supplies. Because of scammers the photos of the for sale in supplies now have to have the seller's name, date, price and a brief description of something not in the photo so say it is yarn for sale the description could be the recommended needle size. It has cut down the fake ads considerably. Also all transactions are via PayPal and the post office reciept for the item posted has to be posted on the page. I have bought far too much of course.
