    On 13 February 2008, was the closing of the Working Group

    965/2006 of 1 September abolished the specific mention in the Motor
    Article 48.1 and could be interpreted that these limitations shall be in general
    speed of cars, these and other issues have caused to be carried out
    a compilation of all the regulatory issues involving
    the autocaravanisme with instruction is the General Directorate of Traffic which
    follows:
    1. Concept.
    Annex II of the General Rules of Vehicles, approved by Royal Decree 2822/1998, of

    These are vehicles of category M (motor vehicles with a minimum of four
    wheels, designed and manufactured for passenger), and although the Directive
    not explicitly say it can be deduced that the ability to have eight seats, as
    maximum (excluding the driver), we have vehicles of category M1.
    However, point 1 of Section C of Annex II of the Directive
    2001/116/EC, when it comes to body types of passenger cars (M1)

    mentions the following: limousine AA, AB limousine door behind, AC Family
    ( "Break"), coupé AD, AE and AF Multipurpose vehicles, not referring to the Motor
    mentioned in point 1, but in point 5, in another category of vehicles that
    called "special vehicles".
    So, admitting that they are vehicles of category M1, the body
    is not included in the rates provided for cars, but in special vehicles, the
    it is not surprising since they are built on the chassis of commercial vehicles
    used in common for the production of vans and light trucks, the

    2. Speeds.
    Article 48.1 a) of the General Traffic Regulations approved by Royal Decree
    1428/2003 of 21 November sets the maximum speed on its way out of town:
    a) By car:
    1. On motorways and dual carriageways: cars and motorcycles 120 km / h; bus
    vehicles derived from tourism and joint adaptive vehicles, 100 km / h, trucks, vehicles
    articulated, tractorcamions, vans and cars with trailers up to 750 kg., 90 km / h, the

    2. In conventional senyalades roads as cars and tracks for the
    other conventional roads whenever the latter have a sidewalk

    4rt. In any type of road where the allowable movement: vehicles
    tricycles and quads, 70 km / h ".

    Being the motor of special vehicles of category M1 "of different
    cars, it is considered that they are not justified to apply the same speed limits outside
    settlement of such vehicles, but those that correspond to other
    vehicles of category M (for the transport of people), giving rise to the following
    speed limits:
    - At motorway and ............................................. ................. 100 Km / h
    - In conventional road signposted as roads and car
    roads with a paved sidewalk at least 1.50 m or more
    a lane for some of the ways the movement ............................ 90 Km / h
    - In all other ways out of town ......................................... ........ 80 Km / h
    These speed limits would be applicable to the motor to circulate without
    trailer classified with ITV your card with the following codes:
    - 3148 (mixed housing vehicle)
    - 3200 (unspecified motor MMA of less than or equal to 3,500
    Kg.)
    - 3248 (MMA motor housing of less than or equal to 3,500 Kg.)
    Moreover, the Motor classified codes:
    - 3300 (unspecified motor of MMA over 3,500 kg)
    - 3348 (MMA motor housing of over 3,500 kg)
    - 2448 (van dwelling)
    It is governed by speed limits apply to trucks (because of its mass
    maximum allowed) and the other vans: 90 km / h on motorways and dual carriageways, and 80
    Km / h on conventional roads.
    On urban streets shall apply to all motor homes, regardless of
    classification code as the other vehicles in the general speed limit
    Generic 50 Km / h in accordance with Article 50 of the General Traffic Regulations.
    3. Stopping and parking.
    Entitled "Stop and Parking", the General Traffic Regulations governing in
    its Chapter VIII (Articles 90 to 94), the rules applicable to such maneuvers,

    Thanks for Google translation, Olley. I didn't translate it as it is exactly the same as the Spanish Instruction but issued by the Catalan Government confirming that the same rules and regulations apply in Catalunya as in the rest of Spain - in this case. Remember, Catalunya is legally similar to Wales or Scotland regarding laws etc. and they have their own rules and regulations

    The Spanish DGT (Traffic Minister) has sent the Spanish Instruction to each and every Town Hall in Spain informing that the Instruction must be enforced and adhered to - but it is just put in a drawer and wilfully ignored. The Town Halls then draw up their own "Ordenanzas Municipales" (Local laws) and forbid the parking of motorhomes in Municipal Parkings etc (wherever a normal vehicle is allowed to park so can a motorhome) - this is completely illegal and the Instruction states that no local laws can amend or distort the content of the Instruction which is a higher law (National law).

    This is the reason that we have lodged a Complaint with the EU.

    The document in Catalan holds much more clout in Catalunya than the document in Castellano (Spanish) and reconfirms the legality of the Instruction - even in Catalunya!!

    Hi Momo, the problem I see is that a Spanish copper says move along, you can't park here, I show him this bit of paper, he shrugs and puts his hand on his gun/stick etc., am I going to argue?? Some people might, but not me.

    thats how they get away with it .do you really think he,s going to shoot you /bash you with his stick?come on franco.s days are over. have you tried showing the papers ?i have n it worked most of the time .got ask/told to move at aguiles ,we had been there a week n it was the same guardia from 5 days before. so lets be fair we had a good time. all the other times we were left to stay. i think momo and the m,home clubs are winning the battle if only slowly. remember authority works on fear. best not get too stroppy with them though. cheers alan.

    Thats what I was thinking, is a copper realy going to stand there reading that lot while the smug fat english man (me) sits there grinning at him, unless its an official letter with a signature then it could have been concocted by anyone.

    believe me i used momo,s letters last winter with success. it is their law . i did let one guardia have a copy as he was very interestedhe came by next day n just waved. i gave the english one first then said wrong one then give them the spanish version ,so they knew i knew what it said. worked for me.

    hi wizzer, the document lets the guardia know that we are aware that the law as been passed to allow m,homes to park with the same conditions as a normal car. if you dont put out awnings or chairs etc, you can park and sleep in your vehicle almost anywhere. its always better to be ready to move as its not good to get there back up but with a little diplomacy i got what i wanted . after all just say sorry n move if they get really stroppy.

    The problem is that 98% of the Spanish police haven't been informed (deliberately) about this new law. When you show it to them they are just flabbergasted! The police have to "obey" the Town Mayors but once they hear about this law they start to question things.

    The Spanish version is on the official letter heading of the DGT and signed by Pere Navarro, the Minister, and every Spanish policeman knows exactly who he is! They wouldn't dream of questioning this document. (I have uploaded it onto the National & Local Police Forums and you would be amazed at their comments!)

    This is the reason we have lodged a Complaint with the UE - which, incidentally, has been approved and is being processed!! :BigGrin:
