Saying that the brakes failed is like saying that the tooth fairy did it! A mechanical inspection by his ins co will probably find out that they could,nt have failed, and if he persist,s with that defense, they will class it as an "act of god" which obviously they dont cover, best he just owns up, takes the ridicule along with the insurance payout!
