This is from Mums Net ..

SWMBO read this one out and asked me what I would do. The lady in question had hired a 4 Berth Motorhome for two adults and two children. When they went to collect it they found that it only had three seat belts only and one of the adults was expected to travel in the back on the side facing seat without a seat belt.

My view was that it was dangerous and the hire company are wrong in trying to hire out a 4 berth MH with only three belted seats. In the event of an accident the person sitting in the back could be thrown all over the place.

Seems a VERY GREY Area .. :(

They rented out a 4 BERTH.....it doesn't necessarily follow it will have 4 travelling seats....just beds for 4.
Many 4 and 6 berth vans simply don't have the payload for more than 2 or 3 people

I think it was up to the hirer to specify how many travelling seats were needed.

Yeah my van is a six berth but only has 4 belted travelling seats, I viewed many with the same
I do think it should have been made clear by the hire company though

a hire company has a duty of care for all its hire contracts.

my 6 berth has four belted seats, we use it as a two bert

The hire company knew how many people would be travelling.
I'd say the hirer could argue that 4 travelling seats was an implied condition of the hire and "of the essence" of the contract.
Personally I'd refuse the van.

Mine will be 2 berth but 4 travelling seats.
You only know about the discrepancies once you're familiar with motorhomes; nobody new to the game would think that a van would be made that didn't have the same number of berths as travelling seats.

Definitely something that should be made clear by the hire company.

Someone hiring a MH for the first time wouldn't, and shouldn't be expected to, know any different. They would assume that berths = number of people who can travel in it.
