Mind you, looking at the picture, you'd have thought the Police would know better.

Looks like it's nothing to do with the way the passengers are traveveling and maybe a lot to do with RFL avoidance.

The word Itinerant springs to mind :)

If there were no seatbelts fitted then it was not an offence...the law says that if there are seat belts fitted they must be worn but if they were not fitted then no offence has been committed. Thus the situation arose because of the lack of tax nothing to do with the seating.

i thought children had to be restrained or not travel?

If it were an adult in the back, maybe. But if the child was under 12 and there was an available belt in the vehicle (front passenger) then as I understand the law, the child should be in it.

3. If your vehicle doesn’t have seat belts
If your vehicle doesn’t have seat belts, for example it’s a classic car, you aren’t allowed to carry any children under 3 years old in it.

Children over 3 are only allowed to sit in the back seats.

These rules only apply if your vehicle was originally made without seat belts.

Indeed, for much of my time driving there were no seat belts. For anybody.

Yep, and the Head Injury Unit at Birmingham did a roaring trade. I believe it's closed now as a specialist unit because of lack of customers since 1983.
Two of my Uni friends owe their prowess as trauma surgeons to the lack of seatbelt legislation in the 1970's.

Yes, I always point out the difference it has made to the doubters. Obviously they don't prevent accidents but in the accident victims that came in to A&E it was possible to guess where in the car they had been sitting. Front seat passenger - worst injuries. Driver - not as bad. Both would have face ripped to shreds on windscreen. Rear passengers got off lightest. Things have certainly improved! Belted passengers surprising lack of injuries.

It depends on the year of manufactuer, I'm not sure of the exact year but around 2005 before that if no seat belts are fitted in the rear passengers can travel in the back. Later vehicles they are not allowed to.

I think common sense states all passengers should be belted..(y)

there were indeed no seat belts, and this worried me. I had three children under 3 travelling in the back of a motorhome. Before seatbelts had been produced, I made my own by clipping the sort of harnesses we used to put on kids to keep them wandering in the street to firmly screwed down bolts on the back seats. These were not as strong as the seatbelts we have today, but kept them from tumbling onto hard surfaces if we had to brake suddenly..... I also had a hammock type bunk for one of the kids, and strapped him into it with a webbing strap round his waist to stop him falling out. Not for use when driving, obviously. Those kids are now in their 50's, so that was a long time ago! I was a very early motorhomer, and in fact bought my first one as a car/mobile nursery with nappies, facilities to warm feeds etc. It was a Commer camper, and we loved it! The raising roof opened from the front, held down by leather straps, and in a high wind was inclined to break the straps and open itself! On the other hand, the engine was inside the cab, with a cover over it. I had a mobile washing machine. I would strap a small dustbin with a lockable lid to the engine cover ,add nappies and detergent, and while driving my 'washing machine' would be heated and agitated! No computers to go wrong in that one. Can't say the same about the large German motorhome I have now!
