The DVSA/VOSA have agreed to exempt the vehile from a Tacho or/and speed limiter.But wheel trims are to be removed !!.

SO ,,at last i have my Mo=Ho legal !! As of 21/6/22. Having been turned away from my normal class 4 MOT on the 19th of may ,due to the", NEW LEGISLATION " being inducted into vehicle tests .I was informed that now ,any vehicle over 3.500Kgs, that has a " Garage Space " or space that could/can be used as carrying a Car/Motorcycle/Shetland Pony !! ?? ?? etc ,MUST now apply for HGV status !! The application forms " VTG1 " five pages can be downloaded from the DVSA website in Swansea ,or sent to you by post.The cost for those is £91.00. After sending in to Swansea ( with photo's ) of the vehicle and , space ,and after considerable time ,they will advise you as to an approved testing station in your area ,for you to book an" HGV1/TGV1 "test.My test centre charged £141.16 including 'Lane Fee !! Be prepared for numerous phone calls (on hold) and emails too with no doubt answers to your queries, which in my case went through five different departments (DVLA/DVSA/VOSA .)SO,,,in all around £250.00 !! Unfortunately ,if you want an additional mode of mobility ,you have to comply !!
 
What is the new legislation titled, link? If you present a converted 7.5tonne horse box as a motorhome that’s what it should be tested at. Bus station in Sailsbury thought otherwise until they had the conversation with DVLA five months ago. I know that isn’t taking account of anything new which is why I ask what exactly it is. Do not believe what a lot of garages and some mot test stations tell you without making 100% certain with your own research. A lot of motorhomes and conversions over 3.5t will already be classed as PHGV depending what the diner chassis/cab was.

Just to add, while it should be tested as a Class 4 MOT you may have to search round for a test place that can accommodate the size and weight of a given vehicle
I don’t think they wee allowed to look inside closed lockers/garage but may be wrong on that. In any event remove motorcycle from vehicle before test to be safe. I once left my handcycle on the bike rack not thinking but didn’t have a problem. There has been a clause about vans carrying things before it isn’t new.

Interesting.

Our motorhome, over 3500kg and with a garage (but probably not able to take a car or motorcycle) has gone for service and MOT today.

I'll let you know what happens.

Again I may be wrong but I don’t think DVSA control MOT do they? I ‘THINK’ what you have fallen foul of is the bit that stops a motorhome being a living van when you carry goods or vehicles but not sure. If you can provide a link I can look further, I am certainly not ringing lol. My first Google search for DVSA new mot requirement doesn’t show me anything.
There is a lot of legislation you can fall foul of without knowing, one example is side facing seats, no seat belts required before and legal before a certain date (was it mid 2007?) but police COULD charge you with carrying an unsafe load.

I too have tried various Google search strings and have found nothing to back up the OP's claims.
I suspect it is different regulations being brought in at MOT that means it is no longer a living van rather than changes to MOT which I think were done last year?
When MOT station tells you something it isn’t always easy to get back to what it should be, took weeks with my mates horse box conversion last year. Eventually got it done as class 4 after they and the tester himself had a long chat with the DVLA but they ended up charging him the HGV price lol.
Can be particularly important if it’s a wagon due to the changes in tyres for MOT last year

I suspect there was an issue with how the vehicle was presented as I said earlier but not enough info to be able to offer advice really. If it was just carrying a motorcycle the easy option is remove motorcycle, bicycles etc an present elsewhere for MOT. Now the title has changed though it may be a class of vehicle that doesn’t comply for class 4 I don’t know. Hopefully op will post more.

Just to add to op, I am not doubting you have had a problem and got the run around, just offering advice on bits I have had experience with 👍

I never looked at the profile, I assumed it was maybe a conversion or had a motorcycle/other vehicle on display. We will have to wait for more info

Is yours registered as a motorhome?

My 8500kgs motorhome passed mot on 8th may, no problem. This living vehicle stuff is for horseboxes etc.

Our motorhome has sailed through it's Class 4 MOT.

We will be changing the tyres when we get back from our son's place as they are now 6 years old and have very very minor cracking - well the front tyres do, the back ones look like new. We will still change them all and keep one of the rear ones as a spare.

Our only (very minor) MOT issue is that by testing it now we have lost the anniversary of the test (last tested 29 July 2021) but we needed to get it done before we went to our son's just in case we have to be at my parents' and this week was the only week when we had nothing else in the diary - and as we had to be home today getting the van done today made sense.

If your V5 says that your vehicle is a 'Motor caravan' it's class 4. Form VTG1 is for registering a HGV for test not a PHGV.

Just found this discussion about the new legislation with VOSA,just badly written and interpreted as usual and he's been taken for a mug. As the new legislation came out in May 2018 I think more motorhomers would hve been affected by now!

I’ve just had my second MOT 3/06/22 and nothing of a sort was said to me passed without problem my garage can take up to 350kg.
Sorry but I think you are mistaken?🤔

If it is in fact a Charisma would it have a Tachometer and or speed limiter fitted. Something doesn’t seem right although I no little about anything that may be over 7.5t. On his other thread linked above it looks like he was carrying a motorcycle

The mot does not see it have access to v5 data. They test as presented and sometimes it's down to interpretation.

A van with camper bits permanently fixed as class 4 regardless. Issue is with garages but if left empty or with camping stuff fine.

If filled with items for sale it's not tested as camper.

If it has go kart or motorbike in found be a race van or living van. Different rules. But not down to v5 classification.

On one of my groups there is an mot tester who keeps on about this topic and the issues he finds with dpf removals etc.

Just had mine tested, 4.5 ton PHGV and large garage, the tester knew I carried a scooter as we discussed it, I even arrived on French Plates and changed them for UK ones at the test centre and it sailed through so I could then tax and insure it UK and refit the UK plates. Luckily the French had never returned the V5 to Swansea when I registered it there but left it on SORN.

I suspect by his name that he does the Trike thing. So perhaps he has a large van/small truck that he uses to cart his Trike around and has added living accommodation to it.
Not what I suspect most people would describe as a motorhome, more like what we see with <Broken link removed>?

Just my thought as he doesn't appear to be replying with details?
