Speeding on M6 Sunday 15th December

My friend has received notice of a possible speeding charge. Police are alleging he was doing 51mph in a 40 zone between junctions 7 & 8 heading north on M6 on Sunday 15th December at 1.15pm. He is adamant there was nothing showing on the overhead gantries indicating a reduced speed limit and to be honest he does stick to the speed limits at all times.
Has anyone else received notification or even challenged a speeding ticket

Would imagine he can challenge it in court plead not guilty, it would then be up to the police to prove with evidence that he was doing 51 while in a 40mph zone of the motorway. Be aware if he looses he will be clobbered for court costs plus the fine and points
 
If and it is a big IF, he believes he was not speeding, then he must challenge it BUT when you say he NEVER exceeds the speed limit, I find that hard if not impossible to believe!
I have owned 3 sports cars but ONLY got a speeding ticket in my bloody MH when not slowing quick enough coming into a 30mph zone from a 50 but no one else to blame but me!
 
The problem with these signs is that they can change for no apparent reason. After you've been in a 50 for 6-7 signs all of a sudden they will change to 40mph and then back again, easily missed.
 
If he has received a NIP then he must state who was driving, then he should get a copy of the evidence and he can plead one way or the other but it could be costly to plead innocent.

If it was on a managed motorway with Hadecs cameras when the camera flashes, there is another camera that also takes a picture of the gantry as evidence of the limit in force at the time. Next t8me you pass one, look for the grey second set of cameras about 50 metres before the gantry with the yellow camera at the side.

Hundred quid, naughty drivers school session, no points........as opposed to?

They can and do change the speed limit at any time which is both confusing and alarming. When a gantry shows 40 mph when you had the impression that you were limited to 50 mph - when did that change? Has the previous gantry sign gone down to 40 mph after you passed under or while you passed under but didn't see it? Will you get a NIP in the post?
 
I was on that road a couple of weeks ago early morning dark and a bit foggy. Driving in a 60mph roadwork section when I found that other cars were slowing down. Then I noticed a metal road sign in between lanes that could hardly be seen. No idea how many I had already missed. Cant be too careful.

Is that information promulgated in law, or even in the Highway Code? Did the Instructors quote any source?

If not the law is unenforceable, and could be challenged in Court.
 
Bearing in mind how often its raining these days and how you can easily do several miles under them I think it would be really useful if the first set with a speed change flashed on and off to alert you to it

Not really as they will know when the camera changed so when the grace period ended,
It would appear that all police forces operate a grace period the same way that they enforce a road speed cameras absolute speed limit above which you will be prosecuted. ie it varies around the country.
Hence the instructors comment that if you achieve the new speed within 30 seconds you will be fine.

More likely to get done for loitering. He does obey the speed limit much to my anoyance

I would ask for a time and dated photo of the overhead gantry signs at the time of the alleged offence.
Apparently you can only do that after you plead Not Guilty and go to court. It will then be disclosed as evidence

IF.. and its a big if,you can be certain you/he/they were not speeding,go to court. However,if whoever has been ticketed is unsure,think about the cost if you lose.... So.... Now,pay the fine,then sit in a quiet corner and divide ALL the times you "Sinned" into the fine. If you are truthfull ( or me ), it will work out at PENCE. Just a thought.

Came up the M6 a week ago and after 20 miles of a average speed limit of 50 mph it drops down to 40Mph average Speed for about 4 miles then back up to 50mph,
It’s in the roadwork section with no overhead gantry signs, perhaps this is were he got clobbered,

The one that I think is excessive is the time money and effort that they put in to seat belt offenders. They are only going to hurt themselves, nobody else.

But how do you know that it is true ?
 
We all have pet motoring offences we think should be or not be prosecuted, but sorry ivory55 have to disagree, it's a parents responsibility to ensure a child wears a seatbelt also although some injuries are caused by wearing seatbelts many deaths and more serious injury are prevented.

It just seems a lot of time money and effort for something that might happen. I am in favour of seat belts but the effort that they put in to enforce it it seems mad. Do they stop and fine junkies who are harming themselves and do cost the nhs money.

I asked for a photo when I was driving at a nudge over 30 in Caergwrle a few years ago.
Cracking photo, clear as a bell received of Me and Mrs Machzone.
I did an £80 speed awareness course. Longest 4 hours of My entire life.
