LONG POST

I have been asked by VWALAN to post the following translation of the Spanish Laws on motor homes because he cannot download. :Eeek:
For others I have put it in the downloads under the touring section.
I simply translated using Google Translate, so some words may not look to be correct :ROFLMAO: but I leave it to you to guess what the gist of the text is.

08/V-74 INSTRUCTIONS FROM THE GENERAL DIRECTION OF TRAFFIC ON THE MOTOR

MINISTRY OF INTERIOR
Subject: Motorhomes

Instruction 08/V-74
The steady growth it has experienced in recent years the movement of the van in Spain and the lack of specific regulation of some aspects related to this activity, led to the adoption at the plenary session of the Senate for a motion urging the Government to take necessary measures to support the development of this practice and regulate the use of motor homes.

For this reason, the General Directorate of Traffic has realized a need to collect and interpret in a single document all those regulatory aspects that related to motor homes, are included in traffic laws and motor vehicles.

1 .- CONCEPT

Annex II of the General Rules of Vehicles, approved by Royal Decree 2822/1998, of December 23, defines a motor home as "special purpose vehicle built, including housing accommodation, and containing at least the following equipment: seats and table and bunk beds that can be converted into seats, and kitchen cabinets or the like. This team will be rigidly fixed to the compartment housing. The seats and the table can be designed to be easily disassembled. "

This and other definitions of vehicles are the result of the transposition of the existing directives on the matter. Specifically the Commission Directive 2001/116/EC of 20 December 2001 laying technical progress Council Directive 70/156/EEC on the approximation of laws of Member States concerning the approval of motor vehicles and trailers, in paragraph 5.1 of section A of Annex II refers to the motor home as "any special category M vehicles manufactured so that include living with the following minimum equipment: seats and table, beds that may be converted from the seats, kitchen cabinets. This equipment will be subject firmly in the habitable zone, although the bureau may be designed to easily removable. "

This is category M ( "motor vehicles with at least four wheels, designed and manufactured for the transportation of passengers") and although the directive (116/2001/CEE) does not say explicitly that it can be inferred to be capable for eight seats, at most, (the driver), we are faced with M1 vehicles. However, section 1 of section C of Annex II of the Directive 2001/116/EC, referring to body types of passenger cars (M1), mentions the following: AA limousine, AB limousine with a hatch rear AC Family ( "break"), AD coupé, AE and AF Multi Convertible, not referring to the Motor
in that paragraph 1, but in 5, within another category of vehicles called "special vehicles" (1).

Thus, admitting that the case of vehicles of category M1, your body is not included in the rates projected for passenger cars but in the so-called "special vehicles", which is not surprising since they are built on the chassis of commercial vehicles used commonly for the manufacture of vans and light trucks, its length typically ranges between 5.50 m. And 8.00, their average height is around the 3.00 m. and its maximum permissible weight is 3,500 kg very often. and in some cases exceeding, constructive characteristics that have nothing to do with a tourism environment and affecting their maneuverability on the stopping distance, behavior in the turns, and so on.

Therefore, notwithstanding the existence of series of vans whose interior has been conditioned as housing commonly known as "Camper", it can be concluded that the motor are normally "special purpose vehicles of category M1", whose existence is concerned, between others, Article 2.2 of the Directive 2001/116/EC of the commission, other than passenger cars and therefore creditors of a specific regulation in a few specific areas such as determining their speed limits on roads outside of town. By contrast, in other aspects as movement, stopping and parking, are governed by the rules applicable in general to all vehicles.

2 .- MAXIMUM SPEED

Article 48.1 a) General Rules of Circulation, approved by Royal Decree 1428/2003, of November 21 provides for speed limits automobiles on the road out of town under the following terms:

"A) For cars:

1 On motorways and expressways: cars and motorcycles 120km / h, buses, vehicles derived from tourism and hybrid vehicles adaptable, 100km / h, trucks, articulated vehicles, tractor units, vans and cars with trailers of up to 750 kg., 90 Km / h; remaining cars with trailer: 80 km / h.

2 In conventional roads marked as automobile roads and highways in the rest of conventional long as these have paved a berm of 1.50 meters or more in width, or more than one lane for one of the directions of movement: Cars and motorcycles 100 Km / h, buses, vehicles derived from tourism and hybrid vehicles adaptable, 90 Km / h, trucks, articulated vehicles, tractor units, vans and cars with trailers 80km / h.

3 In the rest of the roads out of town: cars and motorcycles 90 Km / h, buses, vehicles derived from tourism and hybrid vehicles
adaptive, 80km / h, trucks, articulated vehicles, tractor units, vans and cars with trailers, 70 km / h.

4th In any kind of track where his movement is permitted: motor tricycles and quads, 70 km / h "

Being the Motor Vehicle special category M1 "other than passenger cars were not considered justified to apply the same speed limits outside of town that this type of vehicles, but those for other vehicles of category M (for the transport of persons) , Which would result in the following speed limits:

- On motorways and expressways ............................................. ............... 100 Km / h

- In conventional roads marked as roads for cars and roads paved with hard shoulder of at least 1,50 m. Width or more than one lane for one of the meanings of movement ................................... ............................................... 90 Km / h

- In the rest of the roads out of town .................................... 80 Km / h

These speed limits would apply to cars that are driven without trailers, broken in his ITV card with the following codes:

- 3148 (vehicle mixed housing)
- 3200 (motorhome without specifying the MMA less than or equal to 3,500 kg.)
- 3248 (MMA motor housing of less than or equal to 3,500 kg.)

The motorhome classified codes:

- 3300 (MMA motorhome without specifying further 3,500 Kg.)
- 3348 (MMA motor housing increased from 3,500 Kg.)
- 2448 (bus shelter)

Would be governed by the same speed limits for trucks (on account of its maximum permissible weight) and the rest of the vans: 90 Km / h on motorways and expressways, and 80 km / h on conventional roads.

In urban streets will apply to motor homes, regardless of their classification code, like the rest of the vehicles in the general speed limit generic 50km / h, as provided for in Article 50 of the General Rules Circulation.

3 .- STOPPING AND PARKING

Under the heading "Stopping and parking," the General Regulations governing Movement in Chapter VIII (Articles 90 to 94), the rules applicable to these maneuvers on places to be made, method and form of execution, placement of the vehicle , And municipal ordinances prohibited places, which must be observed by all vehicles in general.

3.1 urban streets

In connection with the sites to be made the stop and parking in urban streets, Article 90.2 of the General Rules of Circulation indicated in its second paragraph to be seen what effect the provisions of the ordinances dictate that the municipal authorities, in connection with which the 93 states:

"1. The regime of stopping and parking in urban streets will be regulated by city ordinance, and may be taken necessary measures to prevent the obstruction of traffic, including time limits for the duration of the parking lot, as well as the precise corrective measures, including withdrawal of the vehicle or when their detention is not provided by the title enable parking in limited areas on time or exceed the authority granted until there is the identification of the driver.

2. In no case may oppose bylaws, alter, distort, or be confused with the precepts of this regulation. "

One of the complaints most often are made before the General Directorate of Traffic by users of motor homes is the prohibition of parking for these vehicles in part or the entirety of the urban streets that some municipalities to incorporate their ordinances.

These regulations are made under Article 7 of the text articles of the Law on Traffic, Traffic and Motor Vehicle Safety, approved by Royal Decree 339/1990 of March 2, which gives municipalities in the area the Act, a set of competencies, including:

"B) The regulation by the Municipal Traffic Ordinance, the uses of urban roads, making compatible the equitable distribution of parking among all users, with the necessary flow of traffic, as well as the establishment of limited parking, to ensure the rotation of parking, ... "

Therefore, in the opinion of the General Directorate of Traffic is indisputable that the exclusion of certain users have to be reasoned and based on objective reasons such as the external dimensions of your vehicle or a maximum permissible weight, but not by his approach of building or use or for subjective reasons such as possible incívicos behavior of some users such as noise at night, dumping of garbage or waste water to the public, monopolization of public space by putting up structures and furnishings or other situations of abuse against which local authorities have effective legal tools to be used in a non-discriminatory against all violators, whether users of motor homes or any other type of vehicle.

The motor can thus carry out the maneuvers of stopping and parking in the same conditions and with the same limitations as any other vehicle.

With regard to the mode and manner of implementation of the stop and parking, Article 91 of the General Rules of Circulation states that these exercises "should be made so that the vehicle does not hamper the movement nor is a risk to other users the track, especially watching the placement of the vehicle and still be able to avoid moving in the absence of the driver. "

As to the placement of the vehicle cited Article 92 of the General Circulation Rules states:

"1.La stopping and parking will be conducted by placing the vehicle in parallel to the edge of the roadway. As an exception, will be another placement when the characteristics of the track or other circumstances so warrant.
2. Any driver to stop or park your vehicle must do so in a way that allows better use of the remaining available space.
3. In the case of a motor vehicle or motorcycle and the driver has to leave his post, you should note, moreover, as it would apply the following rules:
a) Stop the engine and disconnect the boot system and, if removed from the vehicle, take the necessary precautions to prevent its unauthorized use.
b) Stop-operated parking brake.
c) In a vehicle equipped with gearbox, let affixed first gear, in upslope, and the march backwards, in descending order, or, if the position of parking.
d) When a vehicle over 3,500 kilograms of maximum permissible weight of a bus or a combination of vehicles and stopping or parking is conducted in a place with a marked slope, the driver must also leave proper footwear, either by placing wedges and can not employ such purposes as stones or other items not intended to express such a role, either by supporting one of the steered wheels in the curb of the sidewalk, those leaning toward the middle of the road on the slopes upward, and out on the slopes downward. The block, once used, must be removed from the tracks to resume the march. "

Does not provide the General Rules of Circulation other conditions to be met to make the stop or park a vehicle, so this General Directorate of Traffic believes that while any one vehicle is parked properly, without exceeding road markings on the delimitation of the parking, or capping the same time, if any, is irrelevant to the fact that the occupants are on the inside of it and the motor is no exception, but only that the activity that may develop in the interior does not extend beyond the outside through the deployment of elements beyond the perimeter of the vehicle such as stalls, awnings, leveling devices, media stabilization, and so on.

3.2 intercity routes

Article 90.1 of the General Rules of Circulation defines the places where they should be made the stops and parking lots on intercity routes noting that should be done outside the driveway on the right side of it, leaving free the passable part of the berm.

They also generally on motorways and highways is prohibited maneuvers stopping and parking for all vehicles, except in areas specially qualified to do so.

Their application to stop and intercity routes in the parking rules concerning the method and manner of implementation contained in Article 91 of the General Rules of Circulation collected in the previous point, as well as the considerations in relation to parking in urban streets about the presence of people inside the vehicle parked properly, without prejudice to the possibility of stationing in areas of service stations or on private land whose owners can be agreed with other conditions.

Other concepts in some way associated with the parking of cars such as camping and overnight have no reception in the legislation, motor and road safety, so that the body can not decide on its definition nor on its implications.

4 .- SEAT-BELT USE AND STORAGE DEVICES

Use seat belts or other restraint systems properly approved, properly fastened by the driver and passengers of motor homes in both urban and intercity routes.

Failure to meet this obligation by certain people depending on their size and age to match the following requirements:

1 .- Front seats: It is forbidden to circulate with less than twelve years in the front seats unless they use devices approved for that purpose. Exceptionally, when his stature is equal to or in excess of 135 centimeters, children of twelve years may use such a device itself as seat belts for adults that are equipped front seats.

2 .- Other seats: People whose height reaches 135 cm and not exceed 150 centimeters, may use either a restraint system approved adapted to their height and weight or seat belts for adults of which bear these seats.

3 .- In the motor that are not equipped with safety devices approved specially adapted to the size and weight of its users will not be able to travel children under three years of age and those older than three years that have failed to reach the 135-centimeter, can not take a front seat.

The rules set out completely exclude the possibility of occupying the beds or bunk of a van in circulation, since besides the obvious risk to the occupants in the event of sudden braking, collision or rollover, but if you can handle the seats equipped with Retention approved using such systems, provided that the number of people traveling in the vehicle, either in the cockpit as in the carrier housing, not exceeding the legally permitted places that are recorded in the documentation of that vehicle.

5 .- EQUIPMENT

As for the budget which should at least carry-cars, will be in accordance with Annex XII of the General Rules of Vehicle, as follows: One set of lamps that light is required to carry, in a state of service and indispensable tools for change lamps, two portable devices preseñalización of danger, a spare wheel or a wheel with temporary and the tools needed to change wheels or alternative system for the changes to them to offer sufficient guarantees for the mobility of the vehicle.

Likewise, when drivers leave the vehicle and hold the road or the hard shoulder in intercity routes should use a high-visibility reflective vest, certified according to the Royal Decree 1407/1992, of November 20.

6 .- TECHNICAL INSPECTION

According to Royal Decree 711/2006, of June 9, amending certain royal decrees relating to the roadworthiness of vehicles and vehicles, parts and pieces and modifying itself, the General Rules of Vehicles , Approved by royal decree 2822/1998 of December 23, applies the following frequency of inspection to the motor vehicles and housing.

"Joined:
- Up to four years: free.
- Of more than four years: Biennial
- Of more than ten years: the annual "

7 .- AREAS OF SERVICE OR THE RECEPTION

These are facilities designed specifically to serve or to host motor providing a range of services needed for these vehicles, primarily: parking, drinking water supply and place to empty shells.

Unlike the camps in tourism, service areas or host provide the physical space is necessary to park the vehicle and may be publicly owned or privately.

It is known of the existence of about 60 such facilities in Spain, for which, through the motion by the full Senate on May 9, 2006, the Government is urged to create a sign of movement inside paragraph signal service.

The General Directorate of Traffic believes that, without prejudice to the future design and inclusion in the official catalog of signs of a specific signal indicating the location of a service area or a host of motor homes, currently the signal S-122 "other services "in the official catalog of signs of movement added to Annex I of the General Rules of Circulation permitting, by including a simple pictogram, to satisfy this need.

8 .- AUXILIARY TRANSPORT VEHICLES

It is very common for the transportation of motor vehicles assistants, typically bicycles, a motorcycle or a moped small cylinder capacity. This practice is allowed provided it is approved using a rack or a platform for this purpose and when the projection of Excel plant in the motor home, the following conditions are met in accordance with the provisions of Articles 15 of the General Rules of Circulation.

Projection that protrudes from the plant in the motorhome, from the back, up to 10% of its length and if only one vehicle (indivisible load), 15%.
To take all appropriate precautions to prevent damage or hazard to other road users should be protected outgoing limb to lessen the effects of a possible friction or shock.

Must be marked by the signal V-20 referred to in Article 173 and whose features are set out in Annex XI of the General Rules of vehicles. This signal is placed in the rear of the cargo so as to constantly perpendicular to the axis of the vehicle.

Have also made consultations on the possibility that a motor home traveling to tow a car, that possibility is prohibited by Article 9.3 of the General Rules of vehicles that will not allow movement of a motor vehicle dragging to another, except that this is damaged or injured and can not be dragged by another specifically intended for that purpose, in which case it is allowed to drag their town or village nearest where you can be detained without hindering the movement and provided they are not traveling by highway or freeway .

Notwithstanding the foregoing, the movement of a body composed of a motor vehicle and a trailer or semitrailer which is transported on another vehicle, is permitted if the package meets the conditions for driving on public roads and is approved according to Directives 70/156/EEC and 94/20/EC and also does not exceed the maximum allowable length for these sets is that of 18.75 meters to 16.50 meters for trailers and semitrailers.

What was made public for general knowledge.
