Sorry @Jabberwocky I just looked up the road traffic act, turns out we are both wrong:

It is an offence to drive a vehicle in the outside lane of a motorway which is:

  1. towing a trailer; or
  2. a goods vehicle with a maximum laden weight exceeding 7.5 tonnes; or
  3. a goods vehicle between 3.5 and 7.5 tonnes without a speedlimiter being fitted; or
  4. a passenger vehicle which can carry 8 or more passengers with a maximum laden weight exceeding 7.5 tonnes; or
  5. a passenger vehicle which can carry 8 or more passengers with a maximum laden weight between 3.5 and 7.5 tonnes without a speedlimiter being fitted.
A motorhome is a Passenger vehicle M1 (less than 8 passenger seats). M2 & M3 is a passenger vehicles with more than 8 passenger seats. The 3.5 tonnes restrictions are for Goods vehicles category N. Trailers are category O

So a Motorhome (M1 (special purpose body)) of any weight is the same as a car. However speed restrictions do apply to Motorhomes
Motorhomes or motor caravans (not more than 3.05 tonnes maximum unladen weight) 30 (48) 60 (96) 70 (112) 70 (112)
Motorhomes or motor caravans (more than 3.05 tonnes maximum unladen weight) 30 (48) 50 (80) 60 (96) 70 (112)

Note the weight limit applicable is for the unladen weight not the MGVW.

White van man at risk then no limiter except pedal to the metal
It says 'one must be fitted' ,not that it has to work or cannot be overridden.
Hmmmm, number three seems a bit odd. So if you are limited to what? 56 mph/65mph you CAN go in lane three of three but if you can get your overtake done more quickly say at 70mph your not allowed too? Seems a bit strange dunnitt? (n)
It was designed to prevent the under 7,5T scaffold loories crusing in the outside lane at 90+

As @PeteH , all designed by morons. .

But how much more stupid when the driver (who doesn't have to overtake) does so knowing there is every likelihood that he will cause a queue and then refuses to slow down and pull back in when that results. There again, you cannot legislate for the stupidity of morons who just think of themselves rather than considering others.

He doesn't do it " knowing " anything . They are too stupid to even realise what they are doing & are oblivious to what happens behind them.

All this makes me so glad I just hit the button at 53mph and bimble !
Rarely have to worry about speeding except when lower limits are posted of course :)

None of which apply to a phgv motorhome.....it is not a goods vehicle unless you carry goods for gain or reward and any personal goods must be needed in the course of camping.

It is only classed as phg for tax purposes as there is no defined VED category for motorhomes and isnt usually a passenger vehicle with 8 TRAVELLING seats weighing more than 7500kg either.

Why does that make sense when unlimited aren't allowed in the third lane?

Typical dvla cockup.
Whoever wrote that particular bit of text at the time got their can and cant mixed up.
Happens all the time with dvla/dvsa

There seems to be a difference between that which is writen in the highway code and that which was posted by DanielFord, they do not mean the same thing. Daniel may have got the information he posted from the following website http://www.motordefenceteam.co.uk/offence-guide/motorways.htm which seems to be worded as Daniel has posted.

Rule 265
The right-hand lane of a motorway with three or more lanes MUST NOT be used (except in prescribed circumstances) if you are driving

  • any vehicle drawing a trailer
  • a goods vehicle with a maximum laden weight exceeding 3.5 tonnes but not exceeding 7.5 tonnes, which is required to be fitted with a speed limiter
  • a goods vehicle with a maximum laden weight exceeding 7.5 tonnes
  • a passenger vehicle with a maximum laden weight exceeding 7.5 tonnes constructed or adapted to carry more than eight seated passengers in addition to the driver
  • a passenger vehicle with a maximum laden weight not exceeding 7.5 tonnes which is constructed or adapted to carry more than eight seated passengers in addition to the driver, which is required to be fitted with a speed limiter.

Speed limiters
A speed limiter must be fitted on:

  • vehicles with more than 8 passenger seats, eg buses, minibuses, coaches, stretch limousines
  • goods vehicles with a maximum laden weight of more than 3.5 tonnes
Speed limiters are designed to reduce accidents. They limit the maximum speed of a vehicle by restricting the fuel supply to the engine. Having a speed limiter may mean that your vehicle can’t reach the speed limit.

@Chris Lams the wording I got was lifted directly from the Road Traffic Act, which can be downloaded. The highway code, which you have pasted, says exactly the same thing, but in plain English. I probably should have used that instead :D
