Assume you have a Motorhome rated at 3.5 tons, but you still have your C1 entitlement on your licence allowing to to drive a vehicle rated at 7 tons. You are stopped for a weight check and your motorhome is found to be at 3.8 tons. you are fined for driving an overweight vehicle.
Same situation but now you have let your C1 lapse, would you also be charged for driving a vehicle at a weight you are not entitled to drive?

If its plated at 3.5 you are overweight. If it plated at over 3.5 and you have a lapsed c1 ie wrong licence.
