I have enjoyed seeing the sun rise at 5AM ish with my children while parked at Scarborough. It is a freedom that anyone should be allowed to have.

This is a simple pleasure, why should we be denied it?
Because what we might see as a simple pleasure might be a source of irritation to others and it is the job of local authorities to balance those conflicts of interest. As made clear in earlier posts, Scarborough BC were making efforts to provide a balance. It is the apparent planning problem which has stopped them.

so you are on your way down south following the coast for the scenery and you get tired driving and pull in at a convenient spot only to find that you cant stop there :Doh::Doh:

there must be some give and take in this somewhere.
We all, as holidaymakers (and unlike HGV drivers for instance), have full opportunity to plan our journeys such that we shouldn't allow ourselves to become too tired to carry on. There is give and take in that one is allowed to stop wherever there are no national or local restrictions but not where restrictions have been put in place.

as most motorhomes to the untrained eye look the same could this not just have been several motorhomes on a 1 - 2 night stop over ???

Whenever I have stayed there there are a few motorhomes dotted around and sometimes 2 or 3 together. We sometimes park near other vans and socialise. I have never seen vans parked in the same place for more than a couple of nights.

I have never encountered motorhomers shaving in the toilets at Scarborough. Have you seen the state of the public toilets there? You need to hold your breath to survive the stench.

I'm happy to believe you. However, there have been many reports over the years of people ignoring restrictions - and we've seen some ourselves, mainly on West Cliff and in the Marina car park at Whitby (remember it is Scarborough borough we are talking about, not just the town itself). Members of another forum openly boasted about rallying on the Marina car park in Whitby when the caravan site they were going to use was waterlogged.

As I said in my post, that report was from a Rother borough councillor (it was about Bexhill).

Don't be too hard on Scarborough. There are a lot worse places that call themselves holiday resorts. Ever been to Yarmouth ? ::bigsmile:
Now there's a town (or is it). We stopped off to have a look last June.Definately wont be going back.At least scarborough has nice scenery and bays

I am sure I read recently that 1 or 2 Scarborough Councillors are also Caravan site owners. No conflict then!

What basic freedom to park at night? There is no such thing is there? Councils have been able, for years, to make parking restrictions which they think appropriate for their particular area so what legislation would give such a freedom?

Incidentally, I have put in a FoI request to Scarborough Council asking for details of "the information (including references to any legislation) on which the council based its decision that planning permission would be needed and how that overrides the provisions of the Caravan Sites and Control of Development Act 1960 (Paragraph 11 of Schedule 1)".

I had a reply last week and forgot to post it. The reply explained that whilst the Caravan Sites Act deals with licensing, the land concerned must also have planning permission for that use. Allowing use of car parks for overnight camping is against current Scarborough BC policy, so any planning application would fail. The council also believes "There are many other options available for overnight stays with availability on existing large sites as well as the significant number of certificated sites within the Borough." and "established camp site owners could view the use of Council car parks for overnight stays negatively fearing this could harm the viability of existing sites, and similarly applicants who have been unsuccessful in gaining consent for sites in the past may view the Council as being inconsistent were it to pursue this option itself."
