Mot booked for tomorrow and just found I've got a short within the marker lights. I updated them all to l.e.d units a number of weeks ago and all was OK. Checked the van all round today and the marker lights now keep popping fuses.

I had the same issue a couple of years ago with bulbs blown and fittings corroded & the mot inspector said the were not included in the mot. Does anyone know if the legislation has changed over the years and they are now included?

On and off for many years.
If you mean the orange lights down the side of the vehicle it depends on the length of the vehicle.
Some info here:

http://www.opsi.gov....91796_en_14.htm

Side Marker Lights
All motor vehicles first used from April 1st 1991 and having a maximum speed of over 25mph and over 6m long must be fitted with side marker lamps. On these vehicles side marker lamps must be at each side, not more than 4m from the front and not more than 1 m from the rear. The distance between adjacent lamps must be not more than 3m. Side marker lamps must show amber light or, if within 1 m of the rear of the vehicle, may be red.

However I think the regulations may be changing soon or have just changed, at least for trucks.

With our previous motorhome we had an advisory on the MOT that the lights down the side weren't working and I pointed out they were reflectors as the van was less than 6m long.

Only if its a 13 pin socket and includes ANY damage or not working...it is electrically tested by the MOT tester.
Old 7 pin socket is not an MOT item.

Many years towing and Moho since 2004, presently Adria Coral 690SP Platinum.
As my MoT man stated to me and showed the 'legislation/rule' any external lights that are fitted must be seen to work correctly. There is though apparently no rule to say the external side markers have to be fitted. Hence the reflector sort I imagine.

My car failed on that but it was a 7 pin it applies to a 13 pin one as the cover is a secondary hold in device. Free retest though. just a pain to fit it.

Dont know what your man showed you but it wasnt the regs and he needs an mot testers refresher course.
Below is a clip from the MOT testers manual which states (second paragraph from bottom in left hand column.....)

Additional or optional lamps are NOT included in the inspection

Not sure if that page backs up your argument as its heading is "front and rear position lamps and number plate lamps"

So I would not expect it to be talking about side marker lights.

Side markers dont apply to a class 4 MOT.

In any case, the reply was in response to the poster saying his mot man showed him documentation stating ALL fitted lighting must work.

This http://www.legislation.gov.uk/uksi/1989/1796/schedule/9/made. Makes me think they are obligatory in which case surely they must be working at MOT time.

Martin
This I think is the legislation/rule that my man was on about.
Seems like it's a bit of a weird one, my first MH was 6.5metres and had 3 lights on each side, 2nd one was 7.48 metres
and only had 2 (same manufacturer btw) whereas this one is 7.48 and has 4 side lights.
As it was in my original PJ it didnt effect the MoT as the discussion came up ref the point about number of lights and lengths.

A lot of people muddle up the rules for 'construction and use' with the MOT rules..
