Hi has anyone exceeded the 90 day rule using the spouse of an eu passport holder loop hole yet and how did you get on at the border?

Yes.

Came through 2 days ago after spending nearly 6 months out. My passport was not stamped in France, had a bit of a panic about this after it was too late to do anything about it. I asked boarder control in the UK if they could stamp it and was told, there is no need, it is all on the scanning screen, you have nothing to worry about.

I am going to follow this up with an email to the EU helpline, but for now it seems to be all good.
 
I have been following this couple on YouTube. They have been in France/Spain/Portugal for just short of 6 months on his Irish passport.

If you skip to 25.30 minutes it shows their experience through Eurotunnel at Calais without problem.

Interesting that they just asked 'are you married?' with no check.

We could get away with that ;) :giggle:

Or we could mock up a Polish 'marriage certificate', which said something in 'rubbish', so not a false document.
 
Does the EU spouse have to hold an EU passport (along with their British one) or can they travel with their EU national id?

If the EU national ID was issued to a Citizen of that country the answer is Yes.

If the ID was issued to a Resident, but not a Citizen, of that country then I think it depends on when it was issued and on what terms.

For instance my first Polish ID was issued under the terms of the Withdrawal Agreement, the provisions of which specifically state that it can be used for that purpose. Other UK Citizens were advised to renew their older EU IDs on the same terms. I do not know what is the position of older Residents' ID, not renewed, nor for those IDs which were issued after the rights under the Withdrawal Agreement expired.

The default position is best covered by carrying one's passport.

In the case of the couple in the video in post #3 they would both have needed passports to enter UK. EU IDs are not now accepted.

My other half has duel citizenship Hungarian and British but at the moment only holds a UK passport and we are wondering if he actually needs to apply for a Hungarian passport.
Leaving the UK, flash the passport arrive in france show the national Id document. Is this how it works?

At the end of 5 years his Hungarian ID will need to be renewed I presume. Can he still renew ID if he is not living there?

If he is a Hungarian National(i.e was born there) he will always be able to renew his passport.

If I had dual passports I would keep both running - one never knows the future political machinations.

Thanks for starting this thread. Whilst I’m aware it shouldn’t be an issue it’s great to finally read/watch others successfully experience the process. I’m aware of another Funster with similar passports getting home without issue but not sure what they went through at passport control.

Same as my wife and I. We have previously had an email from an EU agency (I have a copy but can’t access it on my iPad, happy to dig it out and post if you like) confirming it’s ok but there’s nothing more reassuring than reading about others experiences.
 
Billylou Would you mind sharing the name/email of the EU agency that you have the email from, please?

I am in the process of getting my dads Irish birth cert, so I can get my Irish passport. It would be useful (once I have the passport) to have the EU agency email that you mention!

I don't think it will be too long before the Schengen rule is modified to 180 in 365 days. Businesses in winter sun destinations seem eager to have it. That alignes with registering for tax in a country if I am not mistaken???
 
My wifes Mother was Irish (gone unfortunately) so we have no access to her Birth Certificate, we have started the process. Of getting one applying online at a cost of £40.00 some six months ago but have heard nothing since,other than an acknowledgment of receipt of said request.

We have emailed without success we have tried phoning to no avail.

Has anyone gone down this route successfully that could advise.

Thanks for your reply Littlewheels, interesting re time scales. I tried to apply online but it wouldn’t take my credit card. It said 60 days at that point.

I had emailed the Dublin records office initially, to check that my dads birth was recorded, and had a confirmation reply within 20 mins!

I have since emailed an application form, but no idea how long that will take. I was going to give it another week then ask my Irish relatives (uncle and cousins live over there) to help - they can phone or visit record offices in Ireland.

If all else fails, I will call at the Dublin records office next time I am over to see them.

Are you sure you applied for the Birth Certificate through the Irish Office or was it an agency. I applied for my Father in laws birth certificate via the office in Dublin and received it within 2 weeks. I think the cost was 20 euros. This was a couple of years ago but I wouldn't have thought things has changed that much.

He can travel on his ID I believe still,although it is supposed to be changing, & you as his spouse using your UK passport.

No He shows id or passport first leaving the Uk to prevent yours being stamped. Always the Eu one or EU id first. prevents mistakes, hopefully.

Although I was born in England, my mother was born in Ireland to Irish parents my birth certificate is an English one, of course. When I first enquired about an Irish passport on the phone to the London Embassy, the answer was, well, you are an Irish citizen then. Apply now. Job done!

You do now - I am same as you, Irish citizen through my Dad, who was born in Ireland. However, to get a passport, one of the documents that I have to provide is his birth certificate.
 
I assumed vehicle insurers won't cover more than 90 days but rules may have changed recently.

You do now - I am same as you, Irish citizen through my Dad, who was born in Ireland. However, to get a passport, one of the documents that I have to provide is his birth certificate.
Oh yes, the telephone conversation confirmed I was already an Irish citizen but naturally supporting documentation was required when my passport application went in. My son's, however, have to first get themselves into the births outside Ireland register and the apply citing their grandmother (my mum). Sadly, my English wife cannot automatically qualify.
 
My darling carer has had to jump through hoops. Grandmas birth,marriage,death cirts. Mums birth, marriage. Her birth, 1st marriage, divorce, our marriage. Cost so far into the hundreds of £’s. Sent off to Ireland with a two year wait ahead.
