Hi.

Having discussed this before with gus-lopez . I am wishing to drive my Spanish regisred car back to the UK for our Daugher to re-import.

As I understand the law, Non SPANISH residents cannot drive the ES registred car in the UK.

So, despite my Spanish insuers insistance that I can drive the car in the UK, is this legal ?

Over to you ?...please ?

This came up elsewhere and I asked the poster to quote chapter and verse prohibiting it. Big silence.

As you are British Citizen but there is no official 'Residence' status or card in UK, you could explain that you are in the process of applying for Spanish Residencia and as such are entitled to visit with a Spanish vehicle, just as I would be with my Polish-registered vehicle.

Cant help with the driving conundrum (we just drove ours home then garaged it till reregistration had gone through)
When exporting it with the dgt get a temporary baja it allows you to take the vehicle back at some point in the future without having to pay import duty.

Don't see why not....our resort residents that live in the UK or Northern European countries all have there own Spanish registered cars parked up for their use while visiting their apartments...However once arrived in the UK!!!! Worth asking a Traffic Cop....they should know My advisor told me that you need to get the car into the UK system, you have 14 days to do so...look on UK Gov web site... Importing a vehicle Ito the UK...

Only applies if you are a resident elsewhere and have proof.

The onus is on you if stopped to prove you are NOT a UK resident.
You have a polish residency I believe.
If I was taking it back to rereg I take chance or do as bolti said and get export plates. Chances of border noticing and bothering is doubtful otherwise.

Can you not sell the Spanish car in Spain....good Spanish secondhand cars are a good buy....is it worth the hassle of driving, ferry and other stuff.
What car is it....?

Those confiscations only refer to vehicles that have been in the UK for more than 6 months, at which point they should have been re-registered.

As far as proving 'UK Residency' is concerned that would be difficult for the police to prove. I do not accept that one has to prove one is not resident, because a British Citizen has the right to come and go.

'Residency' can have different definitions in different legislation and I doubt whether a Traffic Officer is versed in all of them.

Of course the object of the stop could 'condemn himself out his own mouth' :giggle: Police Officers love that.

One of my tenants a Polish man didn't register his car over here and had it taken, he was offered it back from the lockup but it had to be taken out of the country on a truck. I don't know if he collected it as it happened on the last day of his tenancy, I drove him the his new address in Swindon as he had no other way of getting there.

On 2 occasions when entering the Uk at Dover I have been reminded that as a non-resident the vehicle has 6 months within the Uk only.
