Soooooooooo was on the way to Skeggy and a tosser decided to pass me on hatched markings(obviously all the road bits get chucked in this bit ) as he did this a stone shot up and chipped our screen is he liable for the damage? ,all on dash cam.

I believe if its clear to do so you are allowed to use the hatched areas, and even if it wasn't I would still say NO.

I doubt you'll be able to get him to pay up as proving it was the stone that HE threw up was the culprit would be pretty much impossible and I'm not sure that private dashcam footage is always accepted as proof.

If the chip is small then it can be repaired either free or usually for £10 max, we had the same thing happen on our way home from holiday, we'd done nearly 4,500 miles in total and 1 mile from home an idiot speed passed us and threw a stone up, now we've got a very small chip in the low centre of the windscreen.:mad:

I think to claim off the other driver for windscreen damage you would need to prove negligence, insecure load or something similar OK but a stone off the road I doubt it.

There's worse things than a chipped windscreen , as stated repair on your insurance ,no hassle no stress. These things happen , more so on smart motorways if they don't sweep/ maintain them regularly . I am always wary of vehicles joining motorways from hard shoulders . But you can't do much about flying debris
