Help and advice please.
Sitting stationary in a queue of traffic in my Navara, footbrake on as it's an auto. Then "BANG":Eeek:. A white Ford Escort van drives in the back of me. His front end is totalled and my rear bumper is a bit bent. Takes pictures and have two independant witnesses, names and details provided, his details also. Reports to Camptons who direct me to QBE insurance. Give all info and then told that I could "try" to get my £250 excess back from his insurance.
Since I have not been in any sort of accident for a long, long time (being and man and a God of a driver of course, helps).
As i can't find my policy T&C's at the moment, questions are, how do I go about getting my excess back and does this no blame claim effect my no claims bonus?

Won't the other guys insurers cover the cost in full? Don't see why it should affect your policy excess.

Ultimately you could bring a small claim against the other driver.

You don't say if you were injured , but if you were it could form part of your claim.

Nope, not injured and not going to develope "whiplash" any day soon.

That's good news.

As for whiplash don't believe everything that Jack Straw says. He generally talks through his arse.

My wife had an accident about 4 years ago and her neck still plays her up.

Don't understand why you paid anything, the guy who hits you from behind is always at fault and his insurers should bear all costs !

usually in a no fault accident you only pay your excess if you claim the repair through your own insurance company not through the other guys insurance, your company should be claiming on your behalf from his insurance for any damages in full which should not affect your excess.

if for quickness of the repair you are getting it done through your own company then they can request the excess payment on your policy and then you have to claim it back from the other guy, use a good solicitor to contact the other parties insurance company if needed, or if you have legal on your policy use the insurance companies choice of solicitor.

Our work vehicle was hit in march this year it was stationry and hit by a rental vehcile, we got our company to do the repair for quickness - so glad we did as we would be still waiting now for it to be sorted as the claim is still ongoing- we will get there in the end though, even have cctv of the accident and they are still trying to 'pass the buck'

I have heard of the other guy failing to respond to insurers requests-there by causing the no fault driver to loose his no claims because the fault driver refused to acknowledge any accident.Plus the no fault drivers ins co could not be bothered to chase it up,easier just to let the no fault driver pay a bigger premium and loose no claims which stays on record for 5 yrs :Eeek:

If the other guy has reported it to his insurance company, it would normally be the case where they would contact you direct and do their best to persuade you to use their repairers - they get their own discount on repairs - and if a hire car is needed during the repairs they would use their own preferred company.

You are right to be cautious - no blame does NOT mean no claim but I would think that provided the other party accepted liability it would not affect next renewal.

if you take your car for repair they have details of no fault repair you pay nothing they take care of every thing on the repair to your car if there is an injury then contact win solisitors they are online they worked for me got everything sorted plus £2000 for my injury

DO NOT BOTHER WITH YOUR INSURANCE COMPANY THEY CAN GO KNOCK FOR KNOCK EVEN IF IT IS NOT YOUR FAULT

NOTIFY THEM OF THE INCIDENT BUT TELL THEM IT IS FOR INFORMATION ONLY AND WINN SOLICITORS WILL DO EVERY THING FOR YOU :thumb:

WINN SOLICITORS take a no win no fee so long as it is clear your not at fault a hit in the rear is clearly not your fault so it would cost nothing to recover full costs exess repair and injury are all covered

looks like "winns" are more interested in personell damage claims than getting your vehicle sorted..

Plenty of them types of solicitors around if you want to go down that road..

But a straight forward smack up the ar$e with witnesses should be an easy claim with the other guy`s insurance company.

Who would probably sort out quick, rather than pay a solicitors feee`s.... On top.

Thats what i found when i had to claim against another driver in a very similar situation..

It will save you many zillions of pounds when your insurance company review your annual premium, and now you can see how easily things happen which are totally outside of your control.
I appreciate it doesn't affect what you are saying at the moment, but it could so easily apply to you if another unfortunate accident was to happen.

Only problem with protecting NCB is if you pay to protect it they don't play fair :Eeek:If you have a accident they load the premium- yep they still give you your 60% no claims but on the higher premium :whatthe::ROFLMAO:

Firstly the small print.... I am not creating a legal relationship with any one with this advice....

A lot of people are not really aware of the law in the respect of this kind of accident. We have to presume that both drivers have insurance?

the minimum requirement is Road Trafic Acts.. it is up to each person if they pay for third party fire and theft or buy comprehensive insurance. But the minimum is the RTA .. this is to cover injury.

The drive that has been hit will decide dependant on the level of cover he has purchased to eith claim on his own insrance for the repairs and his insurance may or may not recover from the other insurance company.. (Leave the issue of both drivers covered by the same insurance company).. dependant on your policy you may have a legal cover / hire car / etc.,

Lets work on the basis that you decide to claim of the other driver... note I did not say his insurance.. that has nothing to do with the issue at all.. you write to the driver.. you tell him about the loss and ask how he would like to deal with the claim... again not no mention of his insurance, for the simple reason it is HIS insurance and he makes a claim on it not you.

You may want to tell him (or her )... that you will want a hire car or bus or taxi fares while your car is repaired (get receipts).. no you cannot hire a Rolls .. but a vehicle similar to your own that is off the road for the time of repairs. You can claim for reasonable ..note I say reasonable costs for telepehone calls, and letters and a small amount for the time... more if you are self employed .... it is then up to the other party to either pay or pass it to his insurance company... you are under no obligation to do anything with his insurance company at all.

You can go to a solicitor and let them do the letters, there reasonable fees could be claimed but becareful. So what if he ignores the request? then you can go to the county court.. but what if he has no money? or worse no insurance?

If personal injury was involved then the MIB cover that if the other driver was not insured but not for damage to your vehicle.

If you have your insurance company do the repair.. they can take your NCB until they have recovered there out lay.. you can if you wish go after the other drive to make sure that your NCB is recovered.. another story how to do that.. but while lots of well meaning suggestions in the post I would say leave it to the experts - solicitors .. like one person said I personally would not use a claims recovery company. It is very simple to do the work yourself and quicker.

If in doubt p.m. and I can give some advice.

As said Bob... I can only go on my own experience..

Where by mine and the other guy`s insurance`s were dragging their heels so`s to speak, what should have been a simple quick conclusion went on for many weeks..

That is when I decided to contact the other drivers company to get things resolved....

Had he not have had insurance I would have created merry $hit, and been most upset, because I would have had to pay myself or claim from my insurance..

At a cost to me in "Higher" premiums through no fault of my own...

And let it be known that If I knew of anybody driving with "NO" insurance I would not have second thoughts about reporting them...

Clattered by someone whilst parked, swapped details etcetera. It happened late on a Saturday afternoon.

Monday morning, before I'd had any time to do anything, the other person's insurance company phoned me, said that they'd arranged for my vehicle to be trailered to the fixer's and that that afternoon someone would turn up with a hire car which I would keep until mine was sorted. It took the bodyshop about seven weeks (Alfa bits had to come from Italy or something), the car was delivered back to my house and someone came to collect the hire car. I was called at least three times to give me progress reports. I didn't have to do anything - not even make a call to my insurer.

An excellent advert for the other party's insurance company I thought.

I had the same happen afew years ago in a car, I used A firm called Helphire very good, sorted all out with out touching my insurance.

One of the things that can assist is evidence, sometimes from witnesses, but I have my own 2 installed front and rear on a lot of journeys these days - and here is the latest version of one of the 'witnesses'.

As it says towards the end, perhps useful when lending your car to teenagers -

Just to round things off.
After messing around with these "we sort your claim" companies, who only wanted to get me a hire car immediately (my car was drivable but they insisted I take one straight away). They did however let it slip who were the drivers insurance (he could not remember at the time). By the way there is a site that for a small cost will give you the insurance company of any vehicle if you have the reg.
So I dropped them and phoned the guy's insurance direct, from there no problems, "do you want a hire car?, when can we pick yours up?" etc.
Now sorted at no cost to me and no effect on NCB.
Also have one of those cameras fitted to my windscreen, ironically 2 days after fitting it I bumped into a third party:cry:
