Motorcaravans. Which describes it best? (1 Viewer)

Greetings,

Over the last weekend me and SWMBO travelled up North to enjoy our Granddaughters 4th Birthday party.
En route both North and South we stopped at the same Service Area (either side of the Motorway)
Having nothing better to do, I read the 'usual' notice about stopping for a max of 2hrs but it was the rest of the Notice that took my eye.
It stated, words to the effect that, dependant upon the vehicle, there were specific charges, some inclusive of a meal voucher should that vehicle stay at the Services in excess of two hours.
These were the classes of vehicle:
Car
Commercial
HGV
Coaches.

I noted that the Car Park had the facility for the parking of Motor cycles but that class did not appear on the above Notice.

That got my devious mind thinking. Of which of the groups above does specifically a motorcaravan belong? To my way of thinking, it falls into 'None of the above' and, along with the absence of m/cycles on the list, the so called powers that be on that site would have a hard time convincing anyone that they could impose a 'Penalty Charge Notice'

Any thoughts?

depends on the plated weight and tax class. under 3500kg plg Private light goods, so a car. over 3500kg phgv private heavy goods vehicle so same as a lorry or large commercial vehicle

as for parking charges and penalties, any court would look at an individual case and consider whether you accepted the implied contract by parking there. losing a case like that would cost way more in legal fees than the charge

Can't say I like it but it is logical.

A home has dining room, living room, toilet, bath, bedrooms, garden.

A caravan does not.

And for me - it is home the only thing I don't have on Brian's list is a bath

The vehicles we use are not "commercials" as such, although mostly they are van derivatives.
They can be termed "Car", in the same way a bus can.

A vehicle is a "motor car" if it has an unladen weight not exceeding 2540kgs.
That's unladen, not kerbside weight. Many on here confuse the two.
It's a manufacturer's statement and cant be determined by driving over a weighbridge.
A max. weight of 3050kg (3500kg if gas powered) comes into play for vehicles such as mini buses.

If it has an ULW exceeding 2540kg it is a "heavy motor car".
Buses can use the outside lane on motorways, etc. because they are deemed "Heavy Motor Car", rather than a "Large Goods Vehicle".

That being the case, could it be argued that a motor caravan comes within the description of "car"?

There is an easy way to find out what the charge would be..........go in and ask.

of course there is always going to be the archaic description on vehicles

car....motorised carriage
bus......motorised omnibus
motorcaravan.... motorised caravan, aka a motorhome

DVLA and legislation still use the archaic terms at times, such as on some V5 log books. you also see invalid carriage being used for a wheelchair adapted vehicle on occasion but not always. seems to depend upon who you get when the form gets processed at DVLA

the reason I mention this is that the courts would take a view of what is the common interpretation of the words used on a sign. the implied contract will always be there though as there is a sign advising of parking charges and conditions

There are no designated places for motor caravans on MSAs, but some have places for caravans which can be used.. if they are full you can use the car parking area .. if that is full or you are too big then it is acceptable to use the HGV parking..


As for motor caravan.. that describes exactly what it is .. what's the problem ?

Motorhome is another Americanism, the US generic term for a vehicle designed or converted for sleeping in, also known as a Recreational Vehicle .

Caravan is not used, towed RVs are called Travel Trailers, which some UK owners of US caravans have adopted..

All things considered, If a landowner is levying charges, the vehicle is what he says it is and the charge is what he says it is.
If the vehicle owner doesn't like it, tough.
Find somewhere else.
His land, after all.

I hired a Caravan in the USA about 10 years ago. It was a 7-seat thing - like a Ford Galaxy on steroids! Nice to drive though. Went 2,500 miles in 10 days. Fun.
