Hello John. There is really only way you know if your number isn't included and that is if you've been vigilant when giving people your number to make sure that they don't have permission to share it.
Good point about the differences in tick boxes. When I was lecturing on Data Protection I used to make special mention of the differences to ensure that people were informed. Another good practice is when you provide contact details for the guarantee when buying something in a store (Comet, PC World for example). Tell the person on the till that you do not want the details using for marketing purposes. They have a box which they can tick/untick on their system.
You
do have the option to go ex-directory at any stage, even if you have deliberately & knowingly given your permission at an earlier stage. Your personal data is yours and you have the right to change your mind as to who can use it (with a few exceptions) any time you like.
One way someone might lose their personal data rights, though, is if they use their mobile number for business purposes. If you included the number on business letters/flyers/adverts etc you are basically saying "I want your business, here is a way to contact me which I have placed in the public domain".
