Question for the legal beagles ( )

Once a report has been made to eBay that a listing maybe fraudulent, could eBay be held responsible for money losses to the scammers ?
If it went to court would/could it be held that eBay knowingly took part in a scam ( in the eyes of the law, which is somewhat different to what is real you understand !! )

I think a copied ad from back around September as ad says 'just had new brakes and discs for MOT'. The MOT is only until August. And the price is way too low.
