Had a quick read but still not clear. If your points were not removed after the ban then it would follow that should you gain one more speeding point then your license would go again. That cant be right.

Ah, right, your looking at it from the totting up perspective, not actual removal of the expired points from the licence. I can't find the actual rules but this lawyers site indicates in one if the supplementary questions and answers that after a ban is completed the slate us wiped clean and you start again... http://www.motorlawyers.co.uk/offences/totting_up.php

they still try to give you points if you do not have a licence

They dont try....they do give you points, licence or not.
they can also issue a driving ban

Any points or ban awarded start when you do get a licence.
