Using a mobile phone or other handheld device while driving is a serious road safety risk and a criminal offence.


To help make drivers aware of the dangers and consequences of committing this offence, DVLA now issue a letter to all Heavy Goods Vehicle (HGV) or Public Service Vehicle (PSV) drivers who get penalty points put on their driver record for this specific offence. The letter informs the driver of the risks involved if they continue to use hand held devices while driving.


The letter also advises that as well as the fixed penalty and points, the driver may also have to attend a conduct hearing before a traffic commissioner. The letter warns that if this offence is repeated, the driver will automatically be referred to the traffic commissioner, who may then review that driver’s suitability to continue to hold a vocational licence.

As a radio ham I often use a mic.
I have no idea why but before it was illegal ( and the dangers pointed out ) I used to use the mobile ..
However..
Using a mobile with a hands free kit is the same as chatting to someone in the car.. and even using a mic which has usually only got a PTT button on it is not the same as using a fone.
I believe folk miss the issues associated with using a mobile
I do not think the speaking part is the problem.
The phone rings.
You divert your eyes to pick it up
You divert your attention to hitting the right button to answer the call
When finished you may again divert your attention to ring off and place the phone back where it was

Talking on the phone is merely the bit in the middle and proof you did the previously mentioned attention grabbing activities

Yeah I agree we were on the cb all the time. And doing the job up to Scotland with ainscough we where on the radio with the escort it's a load of crap again peter.

Adjusting a hands free or radio a bit different then texting on a mobile whilst driving...many caught doing just that...

Talking on the phone is not the same as talking to a passenger. Hands free kits are legal. Driving with one hand holding a mobile or a microphone isn't. Rightly so.

The rules cover all electronic equipment such as CB etc as far as I know. Not just phones.

Fiddling with the heater controls, or even the radio, is no different.

The lack of attention caused by mobile phone use is pretty visible: speed drops about 10mph (even in town), corners are all shaped like a threpenny bit, indicators go missing etc. We must all have followed one.

Doesn't make any difference they can change the laws until the cows come home, fact is they can't enforce the current laws.
Drink driving, Speeding, Using a phone while driving more chance of winning the lottery than getting caught I should think.
Oh and my favourite dogs fouling all over the local park, when did anyone get prosecuted for that.

This is only our view, it might seem extreme, others may differ. My wife and I belong to an organisation called Roadpeace, it's for bereaved families who have lost love ones due to road traffic accidents. We think that any law that can minimise road traffic accidents should be upheld in any way possible. Mobile phone use whilst driving is out of control and the penalty for using one at the wheel should be much harsher. Small fines are a joke, it should be a minimum 6 month ban and 6 points on the driving licence if caught and when an insurance policy is renewed the offence must be declared and an additional premium charged.

i suggest you DO NOT visit spain anytime soon as they have been having a purge on the very same thing....ie: driving with one arm resting the window sill etc.

It's not being on the fone which is the killer it's the lack of attention whilst driving. So your telling me wen your in the car with somebody u don't talk.....

I have often approached HGV's from behind to find them weaving about in their lane or worse and as I pass they are always f**kin about with something like roll ups sandwiches coffee reading their delivery schedule and their mobile. I'm amazed there are not lots of broadside collisions. Many drive right up each others arses too without a prayer of stopping if they had to and they'd be killed instantly.
Mobile phone penalties are far too small and not policed enough.

Not just truck drivers car driver motorhome driver police drivers train drivers. Pilots do it there on the radios.... It's not the fone it's the lack off attention whilst driving

No it's all the same. U said u see hgv drivers driving to close Flipping about with this with that .... All bad drivers are the same and it's down to one thing lack of attention. No matter if your in a truck coach bus van or car if u don't pay attention ull have a bump.

Yes cars too but they have a lot more room for error a truck on some roads almost fills the lane, swerving about often leads me to overtake them in the 3rd lane

When renewing, insurance always ask about offences/fines/points anyway and an additional premium is always charged even for an SP30 - so that already happens. 6 month ban for using a phone is not the answer. Better enforcement and better education is......

If they aren't swerving around they are overtaking each other with about 0.5 mph difference between their two speeds. The 3rd lane is usually the only option.
