Perhaps one of the reasons that not much effort has been put into tracking down those who watch the downloads is that it will be very difficult to track down and prove who actually was watching it.

Rather than private individuals, so far they have gone for places like pubs. This is one example. One from round here that hasn't gone to court.

Also from what I have read on the internet there seems to be a big difference (in law) between those who watch digital content, those who download it and store it, and those who make it available for others to watch.
