Having genuinely been a victim of a spiked drink i can sympathise, however, as a non drinker, at the time, i realised by my behaviour that it had happened. was the designated driver too, so spiker had a long walk home.
I don't drink if i am going to drive, nursed too many children injured as a result of drink.
Don Quixote, my asthma inhaler is propelled by an alcohol compound, no alternative available, so think a zero ban could be detrimental to some people.

If she drank from a can of redbull not knowing it had vodka in it, at the point she took a swig, surely she would have realised and should have spit it out. If she realised but swallowed you don't then drive and hope for the best. Vodka redbull tastes nothing like just redbull. I can spot vodka in anything, it's a myth it has no smell or taste IMHO.

If she can prove her drink was spiked then she could get off - it is a legitimate defence but very much up to the court. The trouble of course is she has to prove it and I suspect her boyfriend won't be believed unless there is an independent witness. She will also have to convince the court she didn't feel drunk despite thinking she had only had one drink.

Yee has little faith Jim, someone very close to me last year was stopped in London after visiting a night club. She had not been drinking. The layout of night clubs these days is a number of bookable tables where you stand and have bottles of Champagne delivered to your table at some outrageous price. She had not knowingly drunk any alcohol in the club but had her glass at the table while socialising. Like all London clubs there are some unsavory blokes wandering around attempting to tap up attractive young ladies.

Her best friend was not driving and had downed a few vodka's but her condition was far outside what she had consumed. Anyway after getting her into the car back seat the person in question drove some 100 yards where she was stopped and breathalysed. She had around 45 micrograms of alcohol in a later test.

Anyway I attended court with her, after three appearances she had no option but to make a guilty plea as she had no way of proving her drink being spiked.
If you plead guilty then you will be banned if you plead not guilty and found guilty then the sentence will be greater.
She was found guilty but was not banned, she did receive 6 points on her license though. A small price to pay in the circumstances. The legal system can be a minefield...........

I don't know of that many drivers who're randomly stopped for drink drive. Normaly there will have been a moving traffic offence (often caused by intoxication) that attracted an officers attention.
In fairness that intoxication is often evident to others in the vehicle and the driver.
It's a defence that is regularly presented but once closely examined (questions and answers at the scene and in custody, cctv etc) is easily discounted... or shown to be true (rarely though)

Happens all the time, random vehicle check smell alcohol from anyone in the car. Driver takes a breath test. No driving traffic offense taken place. Being stopped outside somewhere that serves alcohol, the chance of smelling alcohol is even greater.
In my case sdc77 the minimal possible sentence was given. That in itself must say something. What do you think?

Exactly what I was thinking! I once had a breath test after consuming 3 pints of beer (I should point out I wasn't driving, it was a friendly traffic copper who I was chatting to) I would have been OK, I was under the limit.

Don't be fooled DF A scientific analyst was involved in my case, his complex charts and calculations take more into account than the size of the drink. What you have eaten how fat or tall you are how long since you slept how hydrated you are the list goes on. If you are relying on your 3 pint rule it will all end in tears.

A zero limit isn't practical because many medications contain traces of alcohol (used in manufacture or as delivery agent). An "almost" zero limit probably would be a good idea......

I think the limit is about right as it is. I can drink a pint of weak larger or small glass of wine with a meal and guarantee that I am not affected and blow below the limit every time. Costco breath tester.

I do rely on my three pint rule, so far it has served me well, and I have never walked into any cars or any other obstacle for that matter! In fact my rule isn't so much 3 Pints, it's more this simple equation:
No alcohol = drive
Alcohol = Shank's pony
